So, because things were much worse in the past, we should just roll over and accept it in the present? You spoke of perspective... but you aren't viewing the whole picture. This is no longer the 1700-1800s. Also, luxury taxes are generally levied on actual luxuries... not technologies required to do business. People 2 centuries ago didnt *require* soap to do business, hence, it was a luxury. (albeit an important one for those with functioning olfactory nerves) What happened a century or two ago shouldn't temper our reactions to what is happening to us now. In fact, it should make us fight bullshit like this even harder. Remember... Those who forget history are doomed to repeat it.

Florida wont have to worry about this too much longer if they keep this kind of garbage up. If this passes, I would imagine no new businesses of decent size would set up shop in Florida if it can be helped, and those that are already there, will soon be looking for ways to move to a sane state. Those that don't move will just pass on the extra cost to their customers, which I'm sure will please all those Floridians

Even worse, this has nothing to do with being on the 'net, as in internet. From what I can tell, even if your network isn't connected to the internet, you are still liable for the LAN tax. I fail to understand what it is that they even think they are trying to tax. This is one of the most outgrageous tax plans I've ever heard of. It's reasoning for existence doesn't even have a basis in reality. How can they tax you for sending packets internally? The whole thing sounds like it was cooked up by one of those people that doesnt even know what a network, much less the internet is.

'Oh, so they have the internet on computers now do they?'

I think that quote about sums up this plan.

This seems to give no credit as far as I can tell. Disney would gladly have you believe that it is "Walt Disney's Winnie the Poo" (quoted from that page) rather than "AA Milne's Winnie the Pooh." As time goes on, and a generation or two passes, less and less kids will associate Winnie the Pooh with Milne, and more of them will think of Pooh as videos and stuffed animals that they can buy at the Disney store in their local mall.

  22. Re:Mickey Mouse on The Double Edge of Copyright Extensions · · Score: 1
The problem is Disney is hypocritical, and have used other people's creations to get to where they are now, and they don't want anyone to do the same. You think Disney should get to keep the rights to their rodent infinitely? Ok, by that same token, they should have had no right to use Cinderella, Alice in Wonderland, The Hunchback of Notre Dame, The Little Mermaid, The Jungle Book, Sleeping Beauty, and a good portion of the rest of their library. They were allowed to profit from the works of others after a certain set amount of time, and now they want to take that same right away from us. You call this keeping things balanced?!?! If things were balanced they would have lost rights to Mickey long ago, just as the people who created a majority of their popular stories did.

When Walt created Mickey, he knew what the copyright limits were, and he obviously still found the incentive to create works. Now copyright is being extended to protect an incentive that wasn't in danger, and to keep the pockets lined of current Disney execs, none of whom, as far as I know, are even named Disney or part of his family.

This isn't selfishness, this is trying to get back the balance which Disney and other media giants are taking away from the populace. If this isn't clear to you, then you have a very dim knowledge of copyright law, what it was created for, and how it helps citizens. Crap like this is what will keep the gutenberg.org library capped in the early 1900s.

Or did you just assume Disney actually created anywhere near a majority of their stories/characters???

Yes, theoretically at least, you have the right to replace the copies of music you own. However, the problem is that the person you downloaded the backup from on napster, they dont have the right to distribute the music. Fair use applies to making backups, not distributing backups. Yes, it is a catch-22, but thats the way it is. You can legally replace your copy, but other people dont have the right to facilitate you making the backup. When it comes down to the letter of the law, if you are worried about having to replace CDs, then you should back them up before they are damaged, not after. If you dont want to go to that trouble, then you need to convince the record company to replace damaged disks, which they wouldnt mind doing if they really cared about customers, which they dont. All of that still doesnt change the letter of the law about rights of distribution though.
