    Jeffrey Archer had a Short Story about something similar. In his book "To Cut a Long Story Short", there is a short story about a thief who steals a tie at a store, making sure all the guards see him and he goes to his home. As the police goes to his home, they a large lot of "stolen" articles, but the police could not prove that any one of them has been stolen (no reports, no complainst, whatever) therefore Police had to follow the presumption that they were the thief's and it was recorded so at the station after the investigation. Police could only convict him for stealing the tie, a petty crime with just a small fine.

    Why is it that we cannot presume of in this case that the software had been properly purchased and the BSA HAVE to prove that it is actually illegaly copied?

    I am not a lawyer, but I think there might be some way to tie Sarbanes-Oaxley into this.
    As a Public Company, TJX is subject to Sarbanes Oaxley.

    Section 302 demands the certification of Internal Control on Financial data. With such shoddy password system I fail to see how they can comply with it.
    Section 404 demands management to assess risk and solve it
    Section 802 accrues criminal penalties for violations to Sarbanes Oaxley and (TADAM!!!)
    Section 1107 accrues criminal penalties for retaliations against whistleblowers.

    I think this guy should get hold of Section 1107 and run it for all it is worth!!!!

    Section 1107 of the SOX 18 U.S.C. 1513(e) states:[23]

    " Whoever knowingly, with the intent to retaliate, takes any action harmful to any person, including interference with the lawful employment or livelihood of any person, for providing to a law enforcement officer any truthful information relating to the commission or possible commission of any federal offence, shall be fined under this title, imprisoned not more than 10 years, or both. I am not sure if posting to a blog could be construed as "providing to a law enforcement officer any truthful information bla bla bla", but I think this is his best shot.

    Sales is not the key.

    TRUST is the key.
    Do you trust your employer is doing this to improve everyone's jobs, reduce costs through enhanced performance and share part of those savings with the workers as bonuses or salary increases?
    Or do you expect your employer to layoff some people and replace them by lower paid ones or even, not replace them, sharing the load among more people who now can do it thanks to the performance improvement already achieved and pocket the savings?

    Which one is more likely?
    Process management is an attempt to bring the predictability of the Assembly Line to the Office/white suit world jobs.

    Actually this is the way "Moral Rights" work in several European Countries and WIPO signers. If as an author you want to scuttle your work, you have the right to do it, but you should in theory reimburse all owners of such given work the price they paid for their copies. I am not sure how that would apply in USA and with the GPL. It is an interesting case.

    When you say "Enter P2P, and now there's a lot of data being transferred between the users, with noone paying for it" you are very wrong. I and all others already paid for it with our flat rate to our respectives ISPs. Or is that money nothing? When you put a price, for something you have to figure out that people will use it.

    If your price manager screwed up on his price calculation, you should not take it on your customer. Fire your manager

    You just got it totally wrong. IBP introduced a new way to meatpack whereby they did not need skilled labor, therefore they did not need to pay the wage premium that such a skilled labor commanded. That is the source of the wage reduction. It is not that immigants entered and were paid less. It is that the new meatpacker needed less skills and now there were more people able to fill that job and that is the reason for decreased wages. Please do your economic analysis right.

    Yep, like in Panama Canal. It is right at your doorstep, you can go anywhere else in the world, the culture is quite similar to USA culture and we are a dollarized economy riding a commercial boom right now. When you retire you get quite a lot of perks just for being retired (or older than 65).

    I like my Win2K machine and I hate the new registration requirements for Win XP. They are too intrusive. Therefore I am migrating myself to Linux. My question is, Are you going to make Civ IV compatible with Win2k, or am I going to NEED to buy Win XP? I do not want to buy Win XP because win2k suits me just fine. On the oher hand, would it play on Linux?

    I believe we are making a false dichotomy here. If people want/need a Linux with Training wheels then somebody will come out and give it to them. I think that is what Red Hat, SUSE and Lindows have been trying to do. On the other hand we should never compromise the main system and make it less flexible for the professional or hard core user. You should always be capable to dig in and dirty your hands as much as you want to and learn in the process. For the majority who do not wish to, there are the trainning wheels. AOL Linux anyone?

    Licensing Software professionals and holding them accountable for software security is the Palladium concept applied to people. Once you have to license "software engineers" in general, you will have them digitally signing their code and then only software duly signed will run on your Palladium Computer. Otherwise, your computer might run (gasp!) pirate code!
    I am assuming the compiler will digitally brand your code with your signature, in order to find out who wrote the "unsafe" code that was breached.

    I agree on this. Why do I feel kind of warm thinking about that many microphones sitting around the city recording every sound (your conversations too) Sorry, I feel kind of paranoid about it. dbMeters are fine, microphones no.
