    It says it goes in and changes everything from "Quake" to "Quack". Could this also be mudging up the code just a little?

    Possible, but it would be unlikely that a string replace would result in a lower framerate - If the affected code branch was executed, an immediate crash would be much more likely. If it wasn't executed, then no differences would be evident, whether they were performance related, or crashes.

    In summary I doubt that they have code in their driver saying If quake3 then overclock else underclock. or something. That would make no sense.

    On the page, they mention that the string "uake" in fact shows up in the ATI drivers. It actually seems to be that they degrade image quality in favor of framerate for Quake. As for making no sense, it is very common for drivers to be optimized for benchmarks at the expense of general use.

    Richard Garriott was a minor character with no lines in Ultima? I think that L. Frank Baum (were he still alive) might be a better example. It would still not be legal, since MGM owns the movie rights, but comparing Garriott to Toto is bizarre...

    Coudn't resist - actually, I'm a fan of public transportation. I used it for years, but my current job is an hour longer - each way - by train+bus than by car. Plus it's a lot more expensive than gas, now that I've paid off my car.

    In fact, they should have to put it on the box itself, in 12-point font double spaced. This would discourage those huge licenses that only consumer advocates read.

    If they were satisfied, they wouldn't need to experience somthing that is not found in day-to-day life. But that is indicative of a different problem. A world of satisfied people is not really a very nice idea. It was explored in "Brave New World," which showed that a society of satisfied people is hardly human. Sometimes, you've got to take the bad with the good. As for drugs, I support legalization. The harm they do is personal, and often less than that of many legal forms of amusement, like overeating.

    Precisely. My post was intended to show the problems with the current approach. Yours further makes that point. It is very difficult to find someone willing to get prosecuted (and persecuted) just to get a law thrown out, so we end up with very unsympathetic people who are probably guilty being the ones who test the laws. It is human nature that a judge will be less inclined to overturn a law if that will free a terrorist, for example. Many judges would be able to resist that inclination, but some would not, as the drug war shows.

    How exactly do you break a law that gives excessive power to a police agency?

    I should have said "get prosecuted using evidence gathered solely under the new rules." Very difficult indeed, even if you find someone willing to try.
