The problem is with closed proprietary software and MS is the biggest example.

If people stay on windows, then MS calls the shots. Who's to say that at some point MS is going to release a patch that disables all Free Software from running on Windows. MS says it is for the protection of users that only software from trusted application developers can be allowed to be executed. Of course RMS et al have not paid MS to be certified trusted application developers.

It doesn't need to go that extreme but when some MS update breaks F/OSS, then the users will be bitching to the F/OSS developers and not rightly at MS.

With all the live CDs available, several quality F/OSS apps such as Firefox and OOo, we don't need to port everything over to entice people to Linux.

People are used to chucking thier old stuff when they move to a new computer with a new OS. doing the same when converting to Linux is not a big deal.

If you let the people get too comfortable though, why will they bother to switch? People switched for LP and cassette to CD because CD's are portable, durable and sound better. I have some CD's and cassette tapes from 1990. The CD's sound fine, not the same with the tapes. Do you see anyone bothering to upgrade to SACD or DVD-Audio? There is no real point as the media only offers a slight improvement ans so people don't want to bother. People are swtiching to MP3 players because they are more portable.

It might seem contradictory but it is how people think. My parents have a linux desktop and they do not suffer from any of the spyware problems all thier friends do, but when the scanner stopped work they were quick to bitch how it was a Linux problem.

My point is that it is hard to accidentaly violate Copyright and copyright is very specific.

You patent the wheel and it doesn't matter if the wheel is built from rubber or wood or steel, it is covered. You copyright say a play and the chances of someone else independently coming up with a play is nil.

Throw ontop of that that independant players can not really compete with the big boys as invariably if someone has thousands of patents you will eventually infringe on one of them.

The issue with MP3.com was a distribution problem. Common sense says they were ok but strict legal definition they were wrong.

Z smiles sharkily "You may or may not violate these couple of patents, but we have 50,000. If we have to through all those patents to find an Iron-clad case, we will sue you into bankruptcy."

    A folds.

That never seems to happen in copyright. To violate copyright, you need an exact copy, as opposed to say that Ford patents the "automobile". There are many ways to build a car but most likely they would all violate the copyright. Without out and out plagiarizing "Harry Potter" it is pretty hard to violate copyright that does not involve violating the distribution rights. That is why most copyright suits are distribution violation suits like RIAA or ownership suits like between SCO and Novell.

Well there are a couple of different issues going on.

One is that current copyright laws are unjust. The Constitution (ya know that little document we have that defines the power and limitations of the government) allows for copyright and patents for the limited time, to promote the advancement of arts and science.

    A) 99+ years is not limited to my sensibilities. When my average lifespan is about 80 years, it means that anything created even before I was conceived will not pass into the public domain, then for all intents and purposes, the copyright is eternal.

    B) There are strong arguments that the current copyright (and Patent) structure of laws actually limit creativity and advancement. Why should our cultural heritage be locked up by Corporations? Why is it illegal to sing "Happy Birthday" in public?

    C) Check out what happens when the RIAA signs a new Artist. Even if they are popular, they end getting bankrupted. we would do the Artists a better turn if we simply violated copyright distributions (remember "Piracy" is theft on the water) and sent $5 to the Artist, they would probably end up about $6 richer than if we legally bought the CD.
