    So tell me if I'm reading this wrong:

    (a)(4) knowingly and with intent to defraud, accesses a protected computer without authorization, or exceeds authorized access, and by means of such conduct furthers the intended fraud and obtains anything of value, unless the object of the fraud and the thing obtained consists only of the use of the computer and the value of such use is not more than $5,000 in any 1-year period;

    This section would make Napster users who downloaded copyrighted files terrorists? I know that the RIAA considers the songs to be something of value and the TOS of Napster specificly states that you are prohibited from trading copyrighted materials. So you have exceeded your authorized access to obtain something of value thus defrauding both Napster and the RIAA.

    And if the law is allowed to be retroactive (in violation of ex post facto), then you have about a million terrorists from the height of the Napster days.

    It may sound a bit far fetched, but the section is vauge enough to allow it and we've seen what companies can do with vauge laws.

    Why are we talking about guns? Some of the people here are unbelieveable! This week has just shown that 19 determined people could kill more Americans with knives and box cutters in one day than guns have killed all year.

    You are talking about banning a tool. Get a grip. A gun on a table, a knife in a drawer, a van in a garage and a plane on a runway all have potential good uses, potential bad uses and potential neutral uses. It's up to individuals to decide how they will be used. Such is freedom.

    I saw this somewhere a long time ago but I think it is an appropriate measure. They say that you can't stop a suicide bomber because they are such fanatics. The Islamic bombers have been promised that they would be martyrs and go directly to heaven. Each person they kill will be their slave in the afterlife. This is what their religion teaches and they fully believe it. So let's use it against them!

    Let's get the bodies and parts in PA identified. The hijackers remains should all be put in steel drums but make sure to fill them only half way. Next, in a large televised event, fill the other half of the barrel with pig remains and excrement. Seal the drums and dump them in the ocean.

    You see, according to their religous beliefs, this process will make them forever unclean and keep them from entering heaven. You have just effectively revoked their martyr status. And the best part is, if you hit innocent people with the pig parts, they can wash it off, fast and become clean again.

    Let's see how they deal with that little bit of terror.

    This may seem to be a stupid question, but I've really been wondering this for a long time:

    What is wrong about supporting Israel?

    As far as I can tell, they deserve a country as much as anyone else does. Israel was at least a country at one time. Palestine was a Roman territiory and most recently a British colony. Why don't any of the Arab nations want these Palestinian people?

    Skip the rest of my questions and just tell me why we should let Israel be overrun and the Jews slaughtered.

    You might not want to mention the Declaration of Independence. Under current theory of the wall between Church and State, it is unconstitutional:

    the separate and equal station to which the Laws of Nature and of Nature's God entitle them

    We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness

    appealing to the Supreme Judge of the world for the rectitude of our intentions

    with a firm reliance on the protection of divine Providence


    People can make whatever ignorant claims they want. These are not the words of people who would ban bibles from public places. Let's do something novel and look at the First Amendment and how CrackElf would have you read it.

    Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

    So now, the (off)topic here is after school use of public property by a religious group. Mr. Elf feels that this is not allowed under the First Amendment. Let's assume he is correct (he isn't) and you will see what else isn't allowed under this interpretation:
    • Free Speech is not allowed on public property. It is listed second to religion so it can't be more important or deserving of more rights. Anyone practicing any Free Speech must do so on Private property at their own expense.
    • There is no Freedom of the Press allowed on public property. In fact, please keep the media investigators 100 yards from any public areas. The Press is only allowed to collect information on private land owned by the media or private people who have granted permission to the press.
    • You are not allowed to assemble on Public property. All protests, including strikes and marches must be conducted on private property after gaining permission from the owners.
    • Feel free to petition the Government at any time from the confines of your own property on your own dime. Do not come to Congress or any public property to ask us for something unless we invite you.


    I'll do the next nine amendments if you would like or someone else can do the Separation Bill of Rights. You'll find that some things don't change much. Maybe Mr. Elf would like to take a Crack at it?

    Ah, but you see, the bible club parents pay the same school taxes that you do. You can't discriminate against clubs with a religous message solely on that ground. That would be the state forbidding the practice of religon and that is unconstitutional.

    I still want someone to show me where the constitution says there should be a separation between the church and state. Try and find it. I see where it says that the government can't establish an official religon or require yor membership for citizenship.

    Keep in mind that the constitution was written to be understood by common people in the 1700's. If it doesn't come right out and say something, it isn't in there.

    IANAL but....

    There is really no single law that covers this so a lawyer would be useless in this case. You could get ten different opinions from five different lawyers and any or all of them could be right. Or wrong. That's what Judges do.

    Now, with the PHP or CGI programs that do something to a computer, it would be a very grey area. After all, the 'attacking' computer is actualy requesting information from your machine. You are simply returning information. Then you can get into the motive of the requestor and the motive of the author and it gets even worse.

    Basically, all a lawyer is going to tell you is his theory of how a set of laws will be interpretted. Only Judges can actualy do the interpretting.

    In my home, we always call Farscape "The Puppet Show." I think it was the only way I could convince my non-sci-fi wife to give it a try. Now she watches every week. She misses most of the subtile bits, but she knows all the characters.

    This is straying off topic a bit, but I think it is worth mentioning:

    First off, if you've ever worked with profesional video recording equipment, you will know that Beta has much better sound and picture quality than VHS. Of course, half inch tape is better than beta and that is where you will find your broadcast programs stored.

    Second, I've always heard that it was Sony's licensing problems that killed Beta. Anyone could license the VHS format and produce tapes, players and recorders. Sony kept a tight grip on the Beta format until it was too late.

    Sony seems to suffer from this pretty often. Just look at the memory stick and the Sony PDA. Both good products that are incompatable with everything else. Maybe someday they will learn...

    I have been buying Linux distros from the start. I have Slackware, Corel, Red Hat and Mandrake sitting in my desk. I also picked up a copy of NetBSD at Comdex just to toy around with. I think that if you like a product and want the company to keep producing, you should buy the product.

    Now I'm not saying that I've bought every OS that I've used, but I buy major upgrades when they come out just to show someone cares.

    I live the the midwestern region of the United States and can give you INDISPUTABLE EVIDENCE of global warming within hours of my home. Look at the plains. Look at the rivers. Look at the moraines across Illinois and Wisconsin. This whole area was covered by a large sheet of ice only a short time ago (in geological terms).

    The Earth has been getting warmer over the last million years or so. What about global erosion? I can show you Devil's Tower in WY where they have lost 1,200 feet of elevation over this same period.

    Of course, no one wants to hear about this kind of cycle because it can't be blamed on Republicans or big business.

    The liberals should just lobby congress or the UN to pass a law telling the Earth to stop changing. We like it the way it is. Stop climate change! Stop the axis wobble! Stop evolution and extinctions. We must protect the planet! Forget the fact that it was here long before us and will be here long after the last human is dust.

    I can see a problem when Microsoft makes it very difficult to use any non-MS product as default. If someone goes through the hassle of installing third party software, they should be given the choice to make it the default. I can see my brother installing it two or three times before calling me to find out why it doesn't work. Has anyone tried WinAmp or Netscape on XP yet? Can they still get set as defaults?

    On the other hand...

    When is Kodak going to port this software over to Linux or BSD? No plans yet? Well, if you dance with the devil, he gets to call the tunes.

    "Illustrator" doesn't mean anything to graphics people but "Adobe Illustrator"

    Sorry to nit-pick, but where I work, Illustrator has nothing to do with Adobe. It's the person marketing asks to create designs for product packaging. Marc, the illustrator I deal with most often, uses QUARK.

    This would be a very interesting thing to see resolved. Yes, KIllustrator is a confusingly simlar name. But the two products are not in direct competition. They don't even run on a common platform. Toss in that one is free and you raise all kinds of questions about damages.

    Tacking something on a generic name is the standard for the industry:
    MS Windows, X-Windows
    AutoCAD, IntelliCAD
    WordStar, Word Perfect, MS Word, AMI Word Pro
    MS Office, Word Perfect Office, McAfee Office
    Adobe Photoshop, Corel Photopaint
    MS FrontPage, Adobe Pagemaker
    MS Windows 2000, Norton Utilities 2000

    See how the same words keep popping up in similar or even totally different packages?

    Maybe there can be a slight change that would solve the problem. Maybe KDE Illustrator as someone suggested.

    Because if some decision isn't reached, it's going to get a lot worse if everyone has to battle over names.
