  10. I'll take a stab at this... on What Do You Get When You Buy a CD? · · Score: 1
    • Am I paying for the CD media itself?
Yes. You are paying for the physical cd, in addition to the artist's value to the item. Same is true with software, the downloadable version is usually cheaper, by $10 or more dollars because you don't get the pretty box.
    • Am I paying for the right to play that particular CD media?
Yes, you play that CD for personal use.
    • Am I paying for right to listen to that particular recording without relying on mass media outlets that already paid RIAA copyright holders through ASCAP?
You're not paying for the right necesarily, because if you borrowed a CD from a friend, you didn't exchange money with your friend to listen to it. I might be missing the point of this question though.
    • What happens if I own the same recording in multiple digital formats?
The same, I guess, would apply if I had a tape/cd version of an album, or a Mac and PC version of a software. My license is specific for that platform. In the case of the tape/cd, it should be identical.
    • What happens if a particular copyrighted material is on several of my media and comes from same master source?
If you are referring more to backing up the content, that should be perfectly legal. You have the right to backup your stuff in case of loss or damage.
    • What if my media is damaged, should I not be able to request replacement?
If it is damaged when you purchased it, such as unable to be player in a device, or cracked, or broken, then yes you should get a replacement for the damage product, so long as the damage was no fault of your own.
    • If I already own let's say Metallica S&M DVD set, am I legally allowed to borrow a friend's S&M CD set, since both media are mixed from the same source [and possibly covered by the same license]?
No because it's like Mac and PC software. I have a license for that platform, not the other. And even though it is derived from the same or similar source, that has no bearing on the final product. It's two distinct products.
    • What are the quality tolerances and who sets them? At which point is the original recording no longer subject to copy limitations? What happens if my used media is scratched?
When the copyright holder losses the copyright, then the copy limitation should be lifted. As for quality adn scratching, I'm not sure what you mean here, unless you're referring to making copies of lesser quality versions of the product. If that's the case, then that's still falls under the usual guidelines. If you redistribute without the copyright holder's permission, you in trouble.
    • I am inclined to believe that the acquiring party simply acquires a license for a particular recording. It is currently implied, at least in my understanding, that the license is perpetual and as such a license holder is entitled to the ability to use the licensed object perpetually, regardless of the media it was originally supplied on or the media player of choice at the moment. If my understanding is correct, and the content is licensed to the consumer, then where is the full license agreement?
There is none. Retailers are coming into this sitaution that developed over the past 10 yrs, with things such as VHS to DVD, and cassettes to CD. I would love to see that ability to convert, but then the retailer/manufacturer will then be forced ot eat the costs, because now the old media is out of date, and frankly, it's unfair to expect the manufacturer to deal with the cost. If you decided to buy that tape back then, that was your decision then. Because there's a newer format now, that probably didn't exist then, isn't anyone's fault. As such, you shouldn't expect a perpetual license to receive the content in a new medium. If you have the original item you purchased, then you can still use it.
    • By the [above] argument, should we not consider it to be a shrink-wrap and thus largely unenforceable EULA?

Why should I, a purchaser (if I spent the money) and user of a product who acquired said product from a distributor who is responsible for the software bundling/creation, be responsible for it's illegal origins?

It's the vendors who should be penalized for the wrong doing, not the user. If Microsoft added software to the Windows without the proper licensing, then Microsoft should be to blame, not I. If GM steals an IP idea from another auto maker and puts it into my new car, it's not I who has to cough up the car, it's GM who has to pay the penalty.

So why is it that SCO thinks the user gets the penalty, and not the originator of the software?

I'm going to ramble a bit on possible examples to prove a point that each human does not need 100 IPs.

Let's look at it this way.
Why would a 1-2 yr old need 100 IPs?

    • Their tonka truck or barbie ferrrari now has upload capabilities?
    • The stroller digitally syncs the mileage to the home base station
    • The baby monitor is now using Wi-Fi to transmit data and allows for web cam uploads.
Hell the kid can't even grip the remote correctly! They can't even whip their own parallel port (read into it as you may).

Now lets look at the more tech savvy user.

    • My cellphone is now referenced by an ip instead of a phone number. By the way, I'm hosting a pr0n site from my cell phone.
    • My TV, Microwave and Washer/Dryer get updates from the web. You never know when yuo need to hack your rinse setting.
    • My car gets its fuel by email and has a built in webcam so you can see the bumper sticker on the car in front of me. If I'm caught speeding, the cop can email me my ticket directly to my car. They can tell me to pull over too. Wow.

According to the article Stanford Univ. has 17 million IPs compared to India's 2 million. The problem is the old allocation of the IP addresses. If a company can't use it, cough it up and reallocate.

Also, why would my own devices need dedicated IP addresses? If I'm on my home network, the machine gets an internal IP address. There's no need for my machine to use anything else. I don't run into issues playing online games. I currently use a Dynamic IP from my DSL provider to access my home box and I can port forward as needed.

One important advice I would give is.... learn from your repetition. Meaning.. if you see that you code very similar functions or code segments that very ever so slightly, maybe there's a new function in there, that could emcompass them all.

    For example:

    • writing tables: I wrote a class to take an array of array, and spit out a table structure. Beats having to write echo statements with td tags, mixed with variables.
    • simple dababase functions: I've knocked out a number of lines using simple code that does the same 3 steps into one function.
    • object oriented code: definitely helps out.
    • apply theory/concepts to work: I've seen the Model/view/controller example applied to non java languages. As well you can use cool things like XML/XSLT to handle data/presentation, there by allowing for multiple display formats.

some times the elegance is in the hack. I rewrote an art project at the company I work for, using our product for the front end, and php for the backend within 6 hours. He originally wrote his from concept to product in a year. Not bragging, just saying. =)

Look into some of the templating engines, like smarty.php.net, it's srecommended at a number of sites (I haven't used it yet), but it will allow for cleaner code, and that's what is important. Accessing code you can easily fix, and change the presentation when needed.

I like the CD sleeves, and they aren't expensive if you know how to shop. If you go and buy the premade CD books, that will cost you money. If you get a loose leaf binder, and the sleeves, you will save 50% or more off the price of the premade books.

I'll put it to you this way. DVDs are a better solution, but I don't like their current prices; I'll wait till they come down to the cost of CDs.

What you need to do is.... House cleaning for CDs. That's right, you need to clean your room. Sorry to sound like your maternal one, but it's the honest truth. I have CDs i know I can throw out. 2) MSIE has a 94%+ market share. It's pretty evident that their got the market share from the sheer availability on the desktop. The masses know little of what browser their use, they just know the icon half the time. So until that changes, but it won't change, the masses will continue to use what's already there at their finger tips, instead of downloading something else that does the same thing. Why take 3 steps, when you can take 1?

    3) Until computer OEMs sell something else, it will dominate. What regular users are going to use Linux, *BSD, OS/2 (has to go there), BeOS... when their software isn't there. Companies aren't going to waste time developing for other platofmrs if the money isn't there. So until Linux gets to the point that my mother can use it (I'm not trying to start the desktop debate because I stand by linux since it IS my primary desktop), don't expect much of a change. Also, the sheer diversity and the nuances of each don't help the situation either. When it gets down to one or two major players for desktop dominance, ONLY THEN will we see the MORE SERIOUS linux competition for desktop dominance, and it WON'T NEED Win-Emulation to accomplish it.

Remember, we ARE the minority (referring to the mass slashdot community knowing more than the average user about computers).
