    if you buy a house directly from the vendor, who do you pay the agent's commission to? that's right, there is no agent and no commission.

    Amazon's system is set up to allow this. I could post a link right here to Amazon that would credit me with a sale. If Amazon is going to wildly accept referrals from their 'patented' referral program the authetication burden should be on them. The user may actually want KaZaa to get the commission and I think that's ok as long as it wasn't installed without the user's permission. For all we know the user may have never heard of the vendor until it was presented to them by KaZaa upon installation. (of course, this was the hypothetical honorable KaZaa I spoke of in my previous post and not the actual sleazy one).

    Randy Saaf of MediaDefender Inc., a secretive Los Angeles company that builds technology to disrupt music downloads, told lawmakers Thursday that some tactics his software can use are legally questionable under U.S. computer crime laws. One such technique, called "interdiction," deliberately downloads pirated material very slowly so that other users can't.

    What if the file being downloaded in question happens to be my own copyrighted file that I allow everyone to view except MediaDefender Inc.? If they're downloading it from my machine, doesn't that violate existing copyright law even with the proposed legislation? If not, does that mean I can download copyrighted files from others with the intention of protecting that copyright? I guess I would need to own the copyright in order to protect it, but then wouldn't MediaDefender need to own it as well? Confusing...

    The dumbest thing about this is that if they really had been upfront about it to people, many probably would have agreed to send their Amazon referrals to KaZaa (or as my dad calls it, "Kaboozoo"), Morpheus, etc.

    The key is being honest and ethical with your users and that's the difference between software and SleazeWare. Burying it in the EULA is almost as bad as not telling the user at all.

    When you say you write for G4tv do you mean you're the one who brings the scripts from the game companies to the studio? (just kidding)

    English teachers are notoriously biased towards students because they can get away with it in such a subjective environment. There aren't any arguments how good someone is in math or the hundred meter dash, but there are always arguments in writing and figure skating.

    It's definitely possible that your teacher took up writing after she failed at acting and blamed the stupidity of other actors as the reason for her switch.

    Sadly, chat lingo is one of many worries at some schools where high school kids can't even give examples of a verb.

    I live in NJ. A few months ago I was getting gas and got out of my car to buy a soda. I saw a man frustrated by how long it was taking the attendent to come over begin to pump his own gas. He looked over at the station attendent with a smug look as if to say, "Yeah I'm pumping my own gas what are you going to do about it?"

    Then I saw the gas pump fall to the ground, but not before a quick shot of gas was projected on to his car. It was a great moment.

    I agree about the the driving age restrictions. They are ridiculous. Currently you have to be 17 and even then you can't drive later than midnight or with more than one non-family member in the car younger than 21. There is always talk of moving the age from 17 to 18. The same people who push the driving age up are the same ones who complain about kids hanging out in parking lots. Sure young drivers get into a lot of accidents, but there are other ways of solving that problem.

    I'm trying to do the same thing with my website: BenGarvey.com

    Rather than looking for very innovative ways of promoting yourself online I think a better strategy would be to work 10 times harder at it than any other band.

    Play your shows and promote your website to the audience, contact online zines (Origivation is a good one for Philly area artists), cross promote with other bands/venues, and try to play gigs at venues with a decent web presence (The Grape Street Pub is a good example in Philly).

    Of course, putting your music out there in high quality music formats (the low quality scheme may trick people into thinking your music is low quality) is a no brainer for indie rockers. Do it.

    Above all else your goal should be to be a few people's favorite band rather than be liked by many. Word of mouth is always spread faster by hardcore fans.

    Not that any of this has worked for me at all...

    If it is illegal to pick locks to enter houses, then what are the locks for in the first place? To prevent accidental lock picking?

    Haha. Good point, but I buy locks to protect my property. With DRM, they're selling you locks to protect their property.

    I don't have a problem with DRM being used if that it what someone wants, but I don't like that the law may require it.

    If it is illegal to circumvent DRM technologies, then what are the DRM techs there for in the first place? To prevent accidental copyright infringement?
