That said, getting a security clearance can be realy arbitrary. I used to work for a foreign national and I got clearance (TS/SI even), while an associate of mine got turned down for having visited Taiwan a couple times in the past year (family is from there).
The way it was explained to me by a judge I know, is that you can exclude (same goes for firing, btw) someone for good reason. You can exclude someone for NO reason. But you can't exclude some one for a bad reason.
You can tell a customer to get out because you feel like it. You can tell a customer to leave because they're causing a disturbance. But you can't throw a customer out because you dislike their wheelchair.
The burden of proof is on the plaintiff in civil cases. The issue is that a civil case quit requires a "preponderance of evidence" to win, versus "beyond a reasonable doubt" for a criminal case.
If its anything like the other ones, it'll also be about 1/3 accurate. I've worked at "spy agencies" and his work is pleasantly fictional, and more accurate than movies like "Enemy of the State" or "Sneakers," but still wrong.
If he was in the loop for some of the things he's writen, then he'd probably be in jail for breach of his lifetime obligation agreements.

Just a thought. If it had been prevented, something else would be the largest attack on US soil. So maybe it already has prevented bigger things?
