    All rights are constitutional. The constitution is not some kind of listing of rights. The people have all rights....The real question boils down to whether privacy is actually a right or some kind of privilege....The frightening trend these days is the federal government seems to want to declare everything a privilege that isn't explicitly listed in the constitution.

    And there are those who claim that, for the general good, the rights which *are* exercized and enmerated (*cough*1st*koff*) should be limited for those who 'abuse' them (translated: 'those views which are opposite but too appealing to ignore').

    The Dreaded BCC.

    I've received E-mails which, on the surface, was sent just to me, only to have been BBC'd to my superiors. This is especially frustrating/embarassing when E-mail which I replied to is quoted and sent to and individual, who then reply to me with BBCs, so that my previous conversation goes out to parts unknown and is privied to who knows what, and I may have no clue who else is 'listening in'.

    I consider the use of BCCs to be sneaky and cowardly, but also as a part of the office culture, so yeah, those E_mails have a life unto their own that you might not know.

    If you read the article, the first thing that jumps out is the date: June 1 to September 3, 2001. In fact, if you'll notice, the IP address they refer to (http://139.142.46.159) is long gone.

    Is it *store* policy that opened software can't be returned? Or do the software makers (Microsoft, Symantec, etc.) insist on it? Or both?

    Good point. The SW makers will point to CompUSA as the policy maker. CompUSA can put up a little notice (either in store on on line) which says "you bought it, you own it", or "exchange only for store policy".

    There are also a few EULAs which consider consent to be physically opening the package which contains the software (Old School M$, and Iomega).

    In any case DO NOT LET THEM COME DO AN AUDIT! They have no right to enter your buisness, and they will not do this without a court order. And if they have a court order your lawyers can fight this easily. It is impossible for them to prove they have a shread of proof, and anything that an disgruntal ex-employee has said is hearsay.

    Once they show up with the court order (and the local gendarmes), you have to let them in, correct?

    In the meanwhile, can you get a lawyer, or do they prevent you from any outside communication while the audit is taking place?

    Any lawyers been there/done that for an on-going search (not necessarily a BSA Audit) to provide legal cover?

    I have to agree with you. He broke the law, and was caught, multiple times. It makes sense that he was locked up for a reasonably long period of time, as he had been arrested a couple of times before, for similar crimes.

    I was going to make a trite comment about 'he should go into politics', but a) not all criminals are into politics (they range the spectrum), and b) we're done worse, c) there's *always* been a niche for the 'bad guy' in society.

    Mitnick isn't the first "bad guy celebrity", and he certainly won't be the last.

    This time, for the Superbowl, 'Drugs pay for Terrible Things'- a man on a subway is confronted by murdered innocents that died indirectly because of his casual drug use.

    I had three variations come right off the bat after watching it:
    • George HW Bush being haunted by Kurdish refugees, asking why he didn't go directly to Baghdad in '91 and topple Saddam when he had the chance;

    • George W Bush being haunted by laid-off Enron workers whose 401ks went down the drain when the execs hijacked the pension; {1}

    • Joe Catholic being haunted by altar boys of decades past for supporting sexual abuse by putting money into the collection basket. {2}


    Don't these bozos realize that the argument can be turned right around at THEM??

    {1} - That was the concept I came up with first. You can elaborate with your own 'silent victims of Dubya's policies'.

    {2} - I had a variation -- non-Catholic woman is confronted by altar boy spectres, who interrupts, and calls for her Catholic husband: "Honey, it's for you."
