We could go on about how bad the system is, but that is irrelevant in the courts. That is correct, for the most part. IANAL, but isn't it so that even though the law is a set of axioms you have to comply to, there is room for a judge to interpret things one way or the other? I'd say the fact that WE exists is proof of God's existence. That is far easier to believe than the Universe simply came into existence on its own. How did God simply come into existence? If this question is invalid (as you could argue), are the arguments for that not applicable to the question "How did the universe simply come into existence?"?

I think it is ridiculous that a lot of people need a religion just to live decent. With decent I mean what is generally accepted within a large set of people, say a culture or some countries. Of course there is no a priori good and evil (this refers to the interesting part of the parent), but I do not think the solution is to blindly follow a religion.
A stable kernel api for drivers is what linux needs as proprietary driver writers make poor quality and buggy implementations. While this is not a kernel one its a good compromise as proprietary drivers are here to stay as much as it would be great if we had free gnu ones inside the kernel.
Even though I cannot say for sure whether this last sentence is grammatically correct, it is truly too complicated.
But now on topic: I personally do not care if it is easier for manufacturers to make the implementation of proprietary drivers easier. I could even argue that this is a bad development and makes free driver development, and moreover open specification, less important for the hardware manufacturers. This is just a possible bad side effect to a userspace driver API; it is an sich a good thing.
I tend to agree. However, there are things like protected mode, privilege rings or other security measures between the hardware and the operating system. Couldn't this protect things like firmware from the OS? I also think about the fact that one needs a MS-DOS floppy to flash your BIOS. Doesn't this have something to do with that you need to be in real modus.

That is not true. The Windows kernel is a hybrid kernel, while Linux is a monolithic kernel. The latter is more massive.
I cannot imagine that the whole Windows desktop is loaded onto a hybrid kernel in kernel space. It would be silly to do so.

Do not try to compare OpenGL with DirectX, but with Direct3D. DirectX is more than only 3D accelleration.
