  1. Coincidence? on Fed Raids Software Pirates in 27 Cities · · Score: 1

Slashdot records lowest traffic since inception.. Not really, but it would be interesting to find out how many /.ers were involved...I've already seen one.

  2. Copyright law broken beyond repair? on Ask Lawrence Lessig About Life And Law Online · · Score: 1

Have all of the piecemeal "adjustments" taken copyright law beyond repair as Jessica Litmann says in her book, "Digital Copyright"? Do we need to start over after throwing out the current copyright law, or should there be legislative attempts to correct the problems in the current law? What would be a good balance between creators rights and "fair use"?

Below is stolen from an e-mail signature:
"Video games don't affect kids. If Pac-Man affected us as kids we'd all be walking around in dark rooms eating magic pills while listening to repetitive electronic music," Karen Price, Nintendo Representative.

  5. First inmpressions on Rent Music Over the Net · · Score: 1

I've read several e-mail comments from people involved in the online music industry in one way or another, that tried the service today. Based on their experiences I wont even waste the time to give it a look. I'm hearing things like 1 1/2 hours in to the download, install and start it up and still not able to get music. Search function for another didn't work. Another on tech support line for close to an hour and still holding. Thats what the American consumer really wants: lack of usability, non portable music, lousy customer service, and a catalog of music that at best, is terrible. Thats why almost every automobile sold has a radio, why we live at drive throughs at the local resturants, don't return broken items to the store where we bought them, and are overjoyed with automated pre-recorded responses.

The overall impression from the people I've talked to, who have tried it, is VERY negative. The interesting part many wanted it to work and work well. Needless to say they are disappointed. This article on CNET talks about the The Recording industies last chance.

So far it looks like they blew it..

You think that's old? My says US Robitics, and has had TWO firmware upgrades to take it from 33.6 to 56K and then to V.90 This was back when the darned things cost as much as a Cable modem does today. ($120+) I think this is the same model Miles Standish used for the Pilgram's connection. ( I could be wrong about that though).

I was a beta tester for @home when they came to my area. It was really great because I had broadband access for 3 months before it was officialy opened to the public and free. Service has always been great, in 1 1/2 years I can count the problems on one hand.

  12. That maybe the case in some areas, but... on @Home Network Approaching Shutdown · · Score: 1

I live in a city with aprox. 100,000 population. The only broadband that is available here (other than installing T-1 lines) is @Home. Cox Cable is suggesting that we sign up for a Juno account if they do shut down, and they will let us know when they are able to offer high speed service again. This is 2 months after they sell me my cable modem for 1/2 price. (p.o.ed about that) I already have a dialup through Earthlink for my notebook when traveling, but now I have to dig out a dial-up modem from the parts bin and install it in my desktop. End of the world no. Inconvenient...Yes.

The point being that I have no other alternatives for broadband and I'll be back as soon as it's available.

If Gates said to hell with all this trouble "I hereby withdraw all licenses, everyone who has MS software or operating systems on their computer must remove them at once. You don't own the software, read your EULA, I do." Each use would be a copyright violation under which they could receive up to $150,000 for each infringment. That's a little more than we pay now.

Think of the ensuing chaos that would take place. (I would have to teach dear old mom Linux, she wouldn't be happy.)With the current state of copyright law in the country where corporate copyright holders have 125 year lock on their IP and no requirement to make it available during that period, Bill Gates and Paul Allen could just sit back on their billions and laugh. Be careful what you wish for you may just get it.

On the other hand I can visualize that other developers would be scrambling like starving cats in a room full of baby chicks trying to fill the gaps. Caffeine sales would go up. Medical costs would rise (insomnia and carpel tunnel related) and eventually we would have another viable semi-user friendly OS.

One thing I figured out early on was that I could fix any Windoze problem by doing a complete reinstall.

Suggested reading is Moses Avalon's "What the Reocrd Companies Don't Want You to Know" You can do a royalty calculation on his website. The Future of Music Coalition has an excellent document that analyzes the "standard contract" explaining how that 16% royalty turns into 6%. Both websites cut through the RIAA spin, and get to the underlying truths.

The truth is that the 90-95% of artists that don't recoup, don't recoup because of inflated expenses, the fact they don't get paid for "special" sales, such as overseas, and record club sales, and music taken out of the label catalog and not available for the public to purchase at any price. If the labels don't sell it, you can't make money off of it. In addition to this, you give up your copyrights to boot.

It took John Denver's Estate 5 years after his death to get a accurate total of his sales in which 19 MILLION more sales were "found". This Article on the RIAA website documents it. Talk about your "smoking gun".

I recently had a conversation with a member of a 60's group who had several top ten hits, his words explain it better than anything else I've ever heard. "If I were going to tell any group that is considering signing a major label contract any one thing it is, get as much money up front as you can, because you will never see another cent from royalties."
