It could be that the IBM 390 smp code is what they are talking about. The linux-2.4.20/arch/s390x /kernel/smp.c to be specific. It is interesting that the final static_void seems to point to the future of non smp where individual addressed processors can have different memory timing values. Perhaps they tried non symetrical but found that the addressing and timing became to difficult. Reading the comments is fascinating. It remains to be seen where SCO is really talking about but I have the feeling that the smp code for IBM processors was the first place to look. The RCU and Numa might be just to throw Linus off track.

However you are essentially right, to create a dcom function exe you need to use MS script libraries that only run on the MS Visual Studio compiler set. To my knowledge I do not know of anyone who has made the MS compilers run under Wine. It would run like a dog with a broken hind leg anyway, and most likely would not get anything compiled into a binary. No who ever built MSblast.exe used an MS compiler. That is almost for certain.

Because the monopoly of MS extends to hardware manufacturers. Until we start to see the majority of hardware manufacturers releasing Linux drivers with their hardware things will not change. Just try to get a simple ps2 scroll mouse working in most linux distros and you will see what I mean. The protocols get changed by manufactures by order of Microsoft so that something that did work all of a sudden doesn't. The biggest manufacturer Logitech is the worst example you get a MS driver set but the protocol is not standard. The same thing happens with Canon printers, scanners, and especially with vid cards other than Nvidia and Sis. The conspiracy is at the hardware level and it makes it really hard for small businesses to use anything other than Microsoft software.

If SCO code did get into Linux by someone other than SCO itself then the GPL will not be tested. If SCO itself put the code into Linux then they will most likely be given the right to have the offending code removed from distros other than SCO Linux. This however is most likely not the case otherwise the kernel code would have a history time line that would state exactly when and who was responsible, and if this did happen I think the good computer journalists would have found out about it already, and let the cat out of the bag. Either way I have the feeling that the judge in the case will skirt the GPL issue all together. I feel that either way Linux will lose big time. The money being thrown at making Linux seem to be illegal is too large and has under the counter sponsorship from the big guys except perhaps IBM.

Typical answer for a realestate agent, however the problem is software license, is it for the customer or the unit? If the software license agreement is non-transferable then there is the problem. Obviously companies like Cisco are hurting and putting the hit on internet companies so the can improve their cash flow. Non transferable software agreements are very questionable and I believe their validity needs a court challenge. In this case I think Cisco and the like will lose, this is clearly a case of purchasing property, so that when this property is sold the software can come with, you could do that with MS windows, in fact up until Win XP this was common, used computers stores would sell your computer with your copy of Windows as long as you provided the original disk and key code. No this is a case of dot com gouging it does not come close to being legitimate. How can you prove that the seller knew that the software was a non resaleble item. Most likely they just thought it was their copy of the software, and thought it was fine to sell it. I am sure that Cisco did not go out of their way to inform the original customer about this rediculous and legally questionable restriction.

The effect is similar to what happened in Spain with printing during the rennaisance, look carefully at the result. SCO is trying to gouge communication tech in the third world, China and the far East as this is seen a the next big market. Microsoft is most likely behind all this and do not be supprised if SCO wins, it is not in the National Security policy of the U.S. to aid communication tech like GNU/Linux. They tried to block 128 bit encription tech and failed, you can bet the next thing the Republicans are going to do is advance Microsoft and Intels lead to be able to block internet communication in the US with so called trusted computing.
