Apple licensed 1-click in 2000 so they could launch iTunes unfettered. Judging that they turned that into the #3 music retailer online or offline (and with less overhead than their offline counterparts), I'd say their licensing of the Amazon patent turned out to be a smart idea. Hindsight 20-20 and all.

Two weeks ago Apple turned a $60m Burst.com lawsuit jackpot into chump change, and they get access to Burst's patent portfolio for what amounts to $5m. I'm not saying it's right or wrong, I'm just sayin'.

You can read the patents in question here. It's an interesting suit -- I can't tell if Klausner has legitimate patents or not, but just because Vonage and AOL rolled over, it doesn't mean that Apple will (disclaimer: my blog link), especially not at those prices.

That high of damages makes me think they want Apple to settle. But that high of damages also makes me think Apple would rather invalidate their patents than settle.

You're totally right -- PalmOS will be replaced by a Linux OS made directly by Palm. That's not the one that was made by the Access Linux Project, which appears to be dead in the water (for the North American continent anyway). If Palm's new Linux OS is as good as Trolltech's QTopia, things will be very, very good for Palm.

Syncing conduits, to be fair, suck on all platforms. I generally think of Palm conduits as the worst, but Apple's Sync Services and Microsoft's ActiveSync aren't exactly winners either -- they just look newer than Palm Desktop. I have had suspiciously similar problems with all of them. My hope is that Palm Desktop dies first.

WRT the iPhone sucking: it probably will suck a lot less than dumbphones, and it will probably raise the bar for smartphone interfaces in general too, which is why there's so much hype about it -- smartphone software interfaces currently suck, and quite a bit. It will be a market success even if only fanbois get it.

Most of the lights in my house are CFLs now. My furnace is much more efficient at heating the house than light bulbs, and I certainly don't miss all the heat in summer.

The weird thing is, for all of the house guests we've had, I don't think that anyone has ever noticed or said anything.

How can you predict continued growth when the market changed in the past month with the conclusion of the lawsuit?

Well, Palm diversified their smartphone market. Before January, they were just selling Palm OS PDAs that were phones. Now, they're also selling Windows Mobile 5 PDAs that are phones as well. So you can buy from Palm regardless of which OS you wanted to run. With the ACCESS Linux platform, I imagine you'll have an additional option in the next year or so. Also, you can't install any applications on a blackberry. There is always that...

Rest assured, the traction is quite good for the device.

T-Mobile used to carry the Treo 600, I think they switched to just Blackberries so as not to confuse their customers. I use T-Mobile quite happily, but T-Mobile's selection of phones is... lackluster. Just because T-Mobile doesn't carry a phone, it doesn't mean it's a ginormous stumbling block for the company. For example, T-Mobile (in the U.S., anyway) doesn't offer Sony Ericsson phones anymore, either.

Also, since T-Mobile is a GSM company, you can use pretty much any GSM phone you want, just make sure you get it unlocked.

Interestingly, the last time I called T-Mobile and asked if they'd be carrying the Treo, the rep started talking desperately to get a blackberry or one of the newer smartphones they had coming out. My prediction is that T-Mobile will start carrying the Treo again; all of their U.S. competitors do, after all.
