So just because a announcement of a revolutionary new battery are now more published it doesn't mean that they are more likely to really turn into a real product.

Learns the defense strategy, gathers evidence, tries to get the defendants on record admitting their actions. The verdict of the first trial doesn't matter then, the prosecutor can then just bring back the dismissed/more difficult charges in a new case.
