True, they wont do it all at once in a case like BP due to the MASSIVE hit they are going to take ( actually, i don't see them surviving in this case, it may be beyond being able to charge it back and keep going ) but they will do it incrementally to gain it back in the long run.
25 cents will drive customers away i agree, but what about 5? Its easier to hide it when you have larger ticket items, 150 before, 160 after and the customer doesn't even notice.
I guess you don't understand the basics of economics. If you increase the cost of doing business for a company, they just pass it along to consumers as higher prices to offset the increased bottom line cost.
CUSTOMERS are who pay the bills for a company, not the tooth fairy or some magic box.
Same concept goes for 'ya, stick it to them evil companies with higher taxes', but that is a different topic for a different day.
Hopefully they goto court, and it becomes a big expensive mess for a LOT of companies that have powerful lobbying arms. Then the patent system might get a 2nd look.
You must be new to the IT world. Its not hard at all to track email sent thru a 'captive' email server. Most enterprise level email servers support tracking and billing. I'm sure if pushed even google, yahoo, hotmail, and similar web email services could do it.
Every email you send thru the system, you get a charge tacked on that goes to the USPS ( well, really the government, they will give the USPS a % of that. )
As far as spam is concerned, it's not about what you receive, its what you send.
Couple that with some good planning and it shouldn't be a big deal to remotely manage it for months on end. Once a year you haul out upgrades and replacements.
All this destroying of real items just to shove in some micro controller board to pretend it still works has got to stop. Its not cool, it doesn't prove you are special or anything else.. Anyone can tear things up. Real talent is restoring an original object to its true glory.

Seriously, what does it matter? The media giants that are fighting our rights really don't care about reality. Even if it was 100%, p2p is the scapegoat and they will continue to spread lies and buy laws to drive it into the ground.
The real solution is to move towards 'protected' p2p where it wont matter what they want to do / say. Then flip them the bird when they cant get a hold of any names to sue, or providers to shut down.

While the FCC is part of the Federal government too, i still trust them much more then congress to try to do the right thing.
