The Tivo and Replay both support the passing through of the closed caption signal. The compression of the video doesn't affect CC.
However, if you are asking do the boxes themselves actually have the ability to generate CC subtitles, Replay does not. The Tivo Series 1 machines can *if* you have the ability and time to go through installing a separate add on program from here:
I bought this external modem (for cheap at the time, $170 which was half price I believe) from USRobotics as a field tester in 1993, and I helped them test the new V.FC 28.8 standard.
After the field test was over, USR gave me a free upgrade to every future standard. So I got V.FC+, V34, X2, and V90 all free. They finally gave up on upgrades with V.92, but the modem died a few weeks ago anyway.
10 years of service, with all those free upgrades. I have to say that lasted a lot long than I thought it would.

When reading the actual release, it says nothing about the DVD-R, except that they've already released a box with a HD and DVD-R that doesn't have Tivo. Checking the Tivo Community, this was an eyewitness to the prototype box at the show:

Yes, I read the article. I'm saying the motivation for writing this article was due to the Advertising sector's lack of enthusiam for a device that can skip ads.
However, you know that the PVRs that are being developed by the cable companies (Time Warner for one) have advertising capabilities built it? Hell, even when looking at the damn program guide they stream ads on the top, bottom, and left hand side. That's why the hope these non-Tivo ones go through, they're probably working with companies developing them to get advertising in from the beginning.
At least Tivo is working with advertising agencies to a certain degree with their Hotline2Hollywood program. In return for allowing your viewing habits to be aggregated and watching an advertisement, you can give feedback on what you think of the ad and the show being advertised. I signed up so I could help Tivo, but I also used it to let ABC know what I thought of the shows they were previewing through the program. This was an advertising experience I actually enjoyed.
Another week, another article proclaiming the death of TiVo. Notice how it's posted by a magazine focused on advertising? Of course they want TiVo to fail, it provides the means for skipping all their boring advertisements.
Will TiVo fail? Possibly. Will it become useless? No. Due to their open architecture, people can and already have hacked the TV guide info, and if/when the day comes they go under, hackers will be able to take up the call and keep the service going.
I hope that day doesn't come, since this well designed hardware and software.
