So while they could easily keep track of who owns their printers, it would be difficult to keep track of who takes which specific printer (serial number) since they all scan the same.
I believe (IANAL) that the reason they get you for uploading and not downloading is that uploading is always illegal. To get you for downloading, they would have to prove you've never bought the CD. (and anyone who got a nasty letter from the RIAA could go out, buy the CD, then show them they've got the right to have a personal copy of it on their computer.)
Actually, I've heard a lot more people talking about how FPSs are old and rehashed already and want something new, and complain about companies re-re-re-releasing games and sequels without any innovation than I have heard people complaining about not getting an upgraded Goldeneye.
