It is shrewd, but I think its shrewd for a better reason then you mention. Face it, sooner or later the SEC is going to f**k up everyone at SCO (although I have my doubts after the DOJ let MS off the hook -- face it, MS is the primary beneficiary of SCO's lawsuit). If they an sue the government BEFORE then, they can claim that the SEC has a CONFLICT OF INTEREST, and the SEC is a hit squad protecting wahtever entity SCO sues. And normally I'd believe them, that is a classic tactic used by the government (remember clinton foes seemed to recieve frequent audits?), but in this case it would be done to head OFF the government.
Suing the government would be nothing short of a brilliant tactical move.

I know of an Audio program at a college which makes heavy use of fair use. One of the excercises is pretty cool -- they buy dvds and soundtracks to movies, strip the audio, and the students assigment is to record the dialog, layer in the sound track, and do the foley and sweetening.
They also have a library of audio cds and dvds for music history courses. The professors used to be given a stack of cds to teach the class with (how can you teach a music history course without music, right?) but now they're given a single CD with mp3s. I imagine eventually the DVDs will be put in a compilation as well...as the professor explained to me it its better to SHOW the students ziggy stardust then just play it for them.

yea but you know that drivers are the primary reason windows is unstable right? if you get conservative, non-flashy hardware, windows is very stable. Win2k is *more* stable under VMWARE then it is on real hardware -- and the reason is the vmware authors are professionals and know how to write drivers. Some chinese kid who makes 8$ a month banging out drivers for generic wifi card #23 isn't producing quality code, and that crashes your computer:)
Thats why Win2k/WinXp/etc like signed drivers. Being signed means they've been throught MS's tests... MS realized they were getting reamed for alot of lockups that weren't their fault.
So whatever linux is doing wrong, its still doing better then MS.
Case in point #1: NEC (in japan) has a water cooled computer now on sale to the teeming millions. water runs over the CPU and goes into a radiator to the back of the case. the radiator sits just outside of the power supply fan, which turns at an incredibly low speed (kinda like the apple G5 fans). Damn quiet.
Um, I've had a watercooled PC for 3 years, and let me tell you something: its a terrible idea. Mine failed twice, once dumping coolant into the (running) computer. It kept the computer very cool, and the case was very quiet, but computers and water are simply not meant to be.
At first glance this seems evil, but you have to know the reasons why. Ceartin european countries have taken it upon themselves to indict US officals and tried them in absentia for "War crimes" and "Crimes against humanity".
I'm working with my two best friends in the whole world and it has already turned into a disaster (i've known these people since grade school). They came up with a great idea, started the business, incorported, got 3 clients, got stuck on a technical hurdle, needed me, I worked 12 - 16 hour days for a month to solve their problem. Problem is we never discussed partnership/employee, now Im holding the software ransom until I get what I want (partnership, they sure as hell can't afford to pay me) and the business and a 17 year and 10 year friendship sway in the balance.
I am ashamed to admit I use MSN Messenger (although I use it through GAIM) -- it goes down about once a week, *usually* on fridays. I assume most of the time thats on purpose, but maybe not last friday:)

I've done shit you *wouldn't believe* while hypo/hyperglycemic, and I agree they wouldn't be the best draftees. Let me repeat, I wasn't actually suggesting that we draft diabetics, I was just trying to point out that desperation is a relative term. What we consider unacceptable in peace time might seem pretty reasonable during war time.

I have in my posession an application to be on the draft board in my county, mailed to me by the Selective Service. YES, THE SELECTIVE SERVICE IS RESTAFFING DRAFT BOARDS. If thats not a wakeup call I dont know what the fuck is.
This is probably the doomsday scenario for linux... We in the OSS community have been saying, "Linux is good, linux is the revolution, linux is freedom and freedom is inevitable. Besides, what can MS do?" And now we have the answer to that question.
The problem with the legal system is it's stacked against the small guy from start to finish. This is how it's stacked: Consequences. There are *NO* consequences for setting out to ruin somebody. None whatsoever. What are the consequences for MS and SCO for this fraud so far? Lots of money. The money train will end, but it will still have been a nice trip for them. We in the OSS revolution need to make sure MS and SCO get their clocks cleaned.
If the SEC/DOJ won't step up to the plate, we need to be prepared to do real damage on our own. -- which is going to suck because there's no legal way to accomplish that -- court rooms and the halls of government are their venues.
I'd be paying mega$$$ in taxes and couldn't afford a down payment.
