    Further, Baazee alongwith several other online indian stores have been summoned by the police in Bombay over the matter of listing fake watches (ones that use the brand name of global watch manufacturers) and other illegal wares on their site for sale. The issue is not just porn, it is selling illegal stuff that they are being pulled up for.

    About time the police cracked down on these guys.

    Other than that, this will lead to these guys cleaning up the content on their sites. Been to Baazee? Almost every section has listings of "X-ray vision" crap. Proof that no one at Baazee reviews what being posted for sale. Tonnes of illegal software is offered for sale alongwith porn and warez.

    Baazee's CEO is not being held for selling porn!! Nor is this about moral standards in India!!

    First, read the law. The IT Act 2000 says:
    Section 67
    ===========
    Publishing of information which is obscene in electronic form
    Whoever publishes or transmits or causes to be published in the electronic form, any material which is lascivious or appeals to the prurient interest or if its effect is such as to tend to deprave and corrupt persons who are likely, having regard to all relevant circumstance, to read see or hear the matter contained or embodied in it, shall be punished on first conviction with imprisonment of either description for a term which may extend to five years and with fine which may extend to one lakh rupees and in the event of a second or subsequent conviction with imprisonment of either description for a term which may extend to ten years and also with fine which may extend to two lakh rupees.

    79. Network service providers not to be liable in certain cases
    For the removal of doubts, it is hereby declared that no person providing an service as a network service provider shall be liable under this Act, rules or regulations made thereunder for any third party information or data made available by him if he proves that the offence or contravention was committed without his knowledge or that he had exercised all due diligence to prevent the commission of such offence or contravention.
    Explanation.- For the purposes of this section,-
    (a) "network service provider" means an intermediary;
    (b) "third party information" means any information dealt with by a network service provider in his capacity as an intermediary;

    Baazee(eBay India) published the sale of the child pornographic material and benefitted from such sale by means of commissions earned. Since they benefit from the sale of the material they should be held liable for the material sold through them. Also, it unlike AT&T which does not intend to benefit from the usage of their service for illegal purposes. In this case, allegedly, Baazee did not remove the porn sale item even after being informed, thereby indicating that they had no qualms from benefitting from such sale.

    I don't know about the US but in India the mass of the IT *pros* are in it only for the money. They have no real enthusiasm for technology or IT. Even most students take up IS/IT engineering courses here only because it pays so well and not because they really wanted to know anything about computer science or IT. The so called IT companies (Wipro/Infosys) also hire programmers from all engineering courses - civil, mechanical, electrical, instrumentation. This will force the music and software companies to sell there wares for cheaper and more reasonable prices. If they don't, then won't sell at all, like now where most of us simply pirate all the stuff!!

  25. Age discrimination - Why? on Age Discrimination, Indian-Style · · Score: 1

    I think the age discrimination is in place at Daksh because the management believes that the younger employees are not responsible enough to handle customers and business.
    Most younger (16-21) employees, typically, are studying and take up working in call centres just to add some more rupees to their pocket money. They don't care a damn about the customer or the business they are supposed to be answering calls for.
    The result, as I found out, is that customer care people are indifferent to customers' rants. Even the threat of withdrawing business from the company doesn't seem to ring a bell in their brains.
    I guess older employees are supposed to be more responsible as working at a call centre is their primary source of income and they wouldn't want to be fired.
    Btw, India has firm minimum wage laws in place. And as far as I know, call centre employees are paid well above the minimum wage level.
