He is the lawyer who helped to write the GPL that nobody (even SCO) will test in court and made it so airtight legally.

Bullshit. The reason that the FSF doesn't go after GPL violators is because the FSF does not want the GPL tested in court. If it's tested and they lose, it's game over, end of line.

Anyone who feels that the GPL is airtight needs to look at the past twenty years of software and technology litigation to see where the 'common sense' answer lies in every suit. It doesn't exist.

This is why the FSF takes the position they do on GPL violations. It is always 'let's yell a lot,' never 'let's sue using our legal instrument.'

  3. Cross-Pollination Rules on Open Source on Windows - Boon or Bane for Linux? · · Score: 1

If someone writes an Open Source app that's appreciated over on Windows, the chance that people will donate in order to keep the project moving increases dramatically. This means that we'll get better applications over in Linux-land and that Windows users will get a better Open Source app over there. There's nothing wrong with cross-pollination. If Ogg Vorbis were only usable on Linux systems, there would be zero adoption of it by hardware manufacturers. The traction it has, even though it's very small, is due to a large extent on availability of Vorbis tools for Windows. This 'writing Open Source apps for Windows hurts Linux' attitude is exactly the kind of flag-waving ideological bullshit that keeps resources (as well as the public eye) *away* from Open Source projects.

I would like to mention that the current acceptence of OGG by hw manufacturers is due almost entirely to the work of Emmitt Plant, who the Xiph people fired.

    Um, no.

The primary reason that manufacturers are adopting Ogg Vorbis is because it's a great codec at a great price. I'm proud of the work I did for Xiph, but I wouldn't go so far as to say that I single-handedly brought Vorbis to portable devices and manufacturers.

Thanks for the vote of confidence and all, but I think that the rabid fandom that Vorbis enjoys has a lot more to do with convincing manufacturers that they'll have an audience for Vorbis-playing devices.

We're working very hard on making the device available for sale worldwide. One of the options (MyFi, the FM broadcast part) means that the Neuros will have to pass through a few regulatory bodies before this can happen. That being said, though, we're hauling ass to make it available anywhere we can.

More importantly, we're trying to find ways to sell in other countries that don't necessitate us driving up the price in places that aren't the US. Other manufacturers (that shall remain nameless) do this, and we're not really interested in soaking foreign users.

I know it sucks, but we're working on it. Please bear with us, hopefully we'll be able to sell to you soon.

I agree that 10% of our proceeds should go to Xiph.org; tonight I will update the web page so that 10% of a purchase will go to Xiph.org as well as the EFF. The reason this change was not done sooner was because at the time OGG-S started, Xiph was not a non-profit organization (charging for the fixed point decoder).

    Sounds great, thanks!

Also, if you believe the name of OGG-S could cause any consumer confusion please feel free to email me at rsage@sidespace.com and I will work on changing our site accordingly. Since OGG-S has been mentioned on the Vorbis mailing lists in the past, I had assumed this name would not cause any confusion.

The fact that someone would package Ogg Vorbis with DRM was inevitable (and welcome, as is any derivative work based on our stuff); The only issue I have with this implementation (as I'm unaware of the technical aspects of it as yet) is that it uses the name 'Ogg.'

That being said, I would very much appreciate it if the name of this product were changed. I'd rather avoid confusion sooner rather than later. After all, 'Ogg Vorbis' was only a project codename, and was never expected to take off. :)
