Well congratulations. He stopped existing several years ago.

Until that annoying bent piece of virtual metal is eradicated off of every piece of machinary on which he ever existed, the powers of darkness wil continue their treacherous reign over anyone who touches a PC... Or is that a little harsh? Seriously though I cannot tell you how many times I have wanted to bend that little POS into the unbendable. Knowing that he is no longer being shipped just isn't enough somehow.

Glad to see that you are up-to-date on your comments, though.

    Thanks!

How right you are. I watched a Judge return a verdict of "not guilty" because the law did not support the prosecutions case. She went on, however, to verbally tongue-lash the defendant for doing something that, while not "illegal," was certainly amoral and of questionable ethics ('twas a white-collar case).

Judges in the the US are bound not only by the statutes, but by the interpretations of those statutes by higher courts. SCO, to choose a random example, is having their head handed to them because they have neither law nor fact on their side. IBM has both and they know how to use it.

I wonder though, if we were to ever find say a fossiled skelaton on Mars, if all the conspiracy nuts would claim it was planted. They are responsible for all of it. If they all said NO to frivolous lawsuits, the problem would pretty much vanish.

In theory you're correct. Reality is, however, far different. If a client comes in and is willing to pay you several hundred dollars an hour to pursue their BS claims (ala SCO) what is the incentive to say no? I did a trial once and calculated, roughly, that the combined billing in the room was close to $10,000 an hour. People are not going to walk away from that simply because someone else thinks it might be "fivilous."

Too often litigation happens because of blood-lust. Disputes can be settled amicably, if everyone agress to share part of the pie, but everyone wants to take the whole thing. Lawyers simply profit off of their greed. No more, no less.

The reality is your logic could also be used to stop all war on the planet. After all, if all governments said NO to war, it'd stop. If you really want to end frivilous lawsuits, then you have to change the system to discourage frivilous lawsuits. 'Tis the only way.

Having worked at several law offices now I can tell you that that is not how things happen. I'm not saying that no one has ever been talked into doing something from a lawyer, but far more common are greedy clients who want to amass voluminous wealth through the court process. Lawyers are certainly responsible for a lot of these messes, but not because they talked people into filing the suit.

To elaborate a bit. MS does not need to file numerous lawsuits in order to utilize patents as coporate weapons. As their own patent head, Marshall Phelps said he's running a "licensing shop, not a litigation shop." Since MS is also attempting to up its patent output to 3,000 this year (think 8 a day!), it follows that they would apply pressure to their competitors through restrictive licensing, more so than through the courts.

How many of those 3,000 patents do you think are truly valid? How many companies are actually capabale of initiating and following through the neccessary litigation required to invalidate just one of those 3,000 patents? The issue at hand is the restrictiveness of the language in MS's licensing agreements, because that is how MS asserts itself with patents.

The Star Trek universe was amazingly constructed by Roddenberry. It allowed for the exploration of countless topics through the lens of thousands of alien worlds. Rodenberry did more in three years with far smaller resources than Berman has managed to do with FOUR different series now! That's what's so frustrating. I think you are oversimplifying things here. This is not about Katie T's rape. This is about Katie T making gobs of money (from the book, lectures, school program, even a TV show!) using the katie.com moniker. Which she does not own! It would be far more appropriate for them to have called it KatieT.com from the get go.

I am sorry that Katie T had to go through what she did at the ahnds of a 40 year old pedophile. But just because she suffered in her past does not give her carte blanche to use another person's domain to help her make money. Katie Jones, the true owner of katie.com, is being harassed and pushed around simply because she doesn't want to give away what she owns and values. In that respect then there is a certain amount of irony involved.
