    From the Copyright Board of Canada: What is "Private Copying"? On March 19, 1998, Part VIII of the Copyright Act dealing with private copying came into force. Until that time, copying any sound recording for almost any purpose infringed copyright, although, in practice, the prohibition was largely unenforceable. The amendment to the Act legalized copying of sound recordings of musical works onto audio recording media for the private use of the person who makes the copy (referred to as "private copying"). In addition, the amendment made provision for the imposition of a levy on blank audio recording media to compensate authors, performers and makers who own copyright in eligible sound recordings being copied for private use. The Copyright Board's decision issued today sets a levy for this purpose.

    Mr. Currie writes: Every song on my hard drive comes from a CD in my collection or from a CD in someone else's collection which I have found on a P2P network. In either case I will have made the copy and will claim safe harbor under the "private copying" provision. If you find that song in my shared folder and make a copy this will also be "private copying." I have not made you a copy, rather you have downloaded the song yourself.

    He is correct to state that the copy he made from his own CD to his hard drive is covered under Canada's Copyright Act. He is wrong to state that downloading a copy from somebody else's P2P application is covered -- it is not "private copying" because the person offering that copy is already in violation.

    The Copyright Act states in section 80, subsection 2 that it is not "private copying" if done for any of the following purposes (my emphasis):

    (a) selling or renting out, or by way of trade exposing or offering for sale or rental;

    (b) distributing, whether or not for the purpose of trade;

    (c) communicating to the public by telecommunication; or

    (d) performing, or causing to be performed, in public.

    Did this guy even read the Copyright Act? Whomever he is downloading this file from is communicating to the public by telecommunication and thus that copy is illegal.

    How many stock ticker listings are there for Sony? One: SNE. It is one company. The profits from each division eventually get funnelled up to the top, then divided back down.

    So by buying a PS2 from Sony, you are helping fund the RIAA and MPAA.

    60 million PS2 consoles worldwide? That is a lot of $$ for a company which the /. crowd has professed to really hate on many occasions. Even averaging say $200 USD for all those sales is an amazing $12 Billion USD in revenue.

    XIII features a plot wherein you are fighting an evil organisation -- in fact there are levels where you _fail_ if you cause harm to an innocent person, even FBI agents which are trying to kill you.

    I can't think of any other GameCube games in which you are awarded points for killing innocent bystanders and police officers, or killing the prostitute you just paid for sex.

    (Yes I have played GTA:VC on PS2 and found it devoid of any redeeming qualities, and in the end quite boring indeed.)

    RockStar can keep their violent trash off of my console, thankyouverymuch. I don't own an entertainment device so I can run people over and shoot cops, I own it to play fun games which help take my mind off the realities of life, one of which includes the fact that people do in fact run over and shoot each other.

    I "bought" a music file from buymusic.com, even though their terms of use state:
    All downloaded music, images, video, artwork, text, software and other copyrightable materials ("Content") are sublicensed to End Users and not sold, notwithstanding use of the terms "sell," "purchase," "order," or "buy" on the Site or this Agreement. Your Digital Download sublicense is nonexclusive, nontransferable, nonsublicensable, limited and for use only within the United States.


    I don't know about any of that crap. Their website is "buymusic.com", not "sublicensemusic.com". I bought my track in DRM-crippled 128 kbps WMA, opened it with QCD, and then saved it as an OGG file and added it to my collection and threw out the WMA file.

    It doesn't play DVDs in the same way that it doesn't make toast or check the oil pressure in your car; there's no need.

    It plays DVD media for games, and it is connected to my TV and stereo. Do you have your toaster or car plugged into your TV?

    Yeah, because we wouldn't want to lose the Gamecube's entire 10 game library

    Even if it were only 10 games, at $50 per game that's still $500 of games.

    Mario Sunshine, Eternal Darkness, Metroid Prime, and The Wind Waker are all "Only for GameCube". Those 4 games alone are in a lot of people's top 10 for all 3 consoles.

    This list excludes sports, racing, and fighters, and as always people's tastes differ greatly. If you like GTA then obviously the PS2 is your machine. If you like Halo then obviously the XBox is your machine. If you like Mario and Zelda, then obviously the GameCube is your machine.

    One would hope that they would not take it "for free" even if it would be "for free" -- I can't imagine it not being better to put in 1-layer emulation for PS1 than to go through 2 layers in the "free" path.

    I have to doubt that the "gamecube2" will be backwards compatible in a similar fashion. I also doubt that it will serve any "dual" purpose such as a DVD player.

    It's really too bad that the current GameCube doesn't play Mini-CD audio or Mini-CD VCD movies... or Mini-DVD movies... etc, etc. Otherwise it's a far superior platform.

    good luck with that. meanwhile, GWB is going to march in and take your oil and it will be portrayed on TV as some sort of Manifest Destiny, with GWB as the One True Hero, for all the sons and daughters of the US to emulate.

    and what is the lesson GWB is teaching to those watching at home? might makes right. and those that don't Believe are persecuted and called traitors and asked to leave the country if we don't like it here.

    words and art do not create feelings which do not exist -- they reveal feelings which already exist. there are reasons why kids are growing more and more violent, but these reasons have nothing to do with which video games they are playing -- if they did not have violent feelings already they would not be playing violent video games. they choose the art which suits their feelings, not the other way around.

    humans are a violent species -- we're wired for physical violence from head to toes. one would think that we would rather kids excercise their violence through video games than through other people.

    I hit the BitTorrent download of the XIII demo and played it. I really enjoy this game and hope it translates well to the GameCube -- I still haven't picked up a requisite "4-person shooter" for my Cube yet and this one looks fantastic.
