    ...by price gauging and digital music is the winner. Now ALL the RIAA need to do is work with consumers to provide even better, more economic ways to offer legal music rather than wasting their energy chasing the 55mm Americans who gave up on OVERPRICED CDs and protested by downloading free music. Now the legal music sites are up the consumer is showing they are basically law observing people who just wanted a decent and legal deal. So tell me why is the RIAA still so obsessed with chasing 55mm Amaericans when digital music legally provided is already the winner. All they had to do was provide the service and "they" would have have come.....as they have now. I await a judge to throw out the RIAA scare tactics and suggest they disband as they have lost the war and their owners are now the providers of digital music. Game Set and MP3.....

    Who says it's the Law? This young Lady MAY have broken the Law, or she may not. The issue never went through Due Process. This was denied her (and her mother) because they were facing extortion amounting to perhaps $100K or more, IF they did not throw themselves on the mat before the RIAA and admit "guilt" and pay $2K to the RIA. An amount this family obviously cannot afford. But worse they cannot afford a bankrupt existence which was the choice the RIAA apparently promised IF they contested this charge. i.e. this family could not afford the Legal Fees to properly consider a defence. It matters not whether you THINK they may have broken the IP Law. This poor family was DENIED their Right to DUE PROCESS because the RIAA had unlimted power and unlimited money to swamp such individuals. Is this the kind of Law we want? The Law per the RIAA and any such Corporate outfit which can break individuals w/o due process? So much for everyone being EQUAL. The RIAA now can destroy poor families at will without Due Process. Scary.......

    While the RIAA waste time and effort chasing the little people that the music industry have been overcharging for years, for their illegal music file swapping, we finally have a REAL Step forward. The music industry was already found guilty of overcharging for CDs and had to announce rebate procedures, but it seemed CDs still did not fall in price so their appeared to be no genuine effort to correct the real wrong. Well UMG (Vivendi) just announced they will lower the MSRP on all their music CDs to a max of $12.95 across the board. Finally we will have a price war and a more reasonable source of music as actual Sales prices will fall below the $12.95 especially is other companies are forced to act. And maybe this will help legal CD Sales climb. SO RIAA forget the little people and MAKE you owners join in pricing CDs as more regular prices.... Time for peace and more Sales of legal music.

    The "mistake" Archos is making is in chosing what functions I want and giving us an expensive package which cannot be further tailored. I might have use for such a device IF it could effectively replace some other high priced piece of electronics. How about offering a GPS add-on? I don't want to buy a $2K GSP and screen in all the family cars. But one unit based upon this Archos would actually save me money and be transferable and usable as an entertainment device when not actually moving.

    directv have been very clever. Talk to ANY Lawyer and they will likely tell you "pay the money and get a letter from them closing the matter w/o admiting to any crime and the matter goes away". Why would ALL Lawyers advise clients like this? Because it's cheaper than fighting a large organization which has scores of corporate Lawyers. This is what is wrong with our "Legal System". You are NOT innocent until proven guilty!! You are guilty unless you can AFFORD a whole bucket of money to fight back. This is why the RIAA and directv are clever. They KNOW THIS and they USE the System for their own ends and do NOT CARE trampling innocent people in with guilty people.

    The RIAA I note is going after people they consider "heavy" traders of files. Given that stats say that 57mm trade files they must be going for some pretty easy targets. Well easy in their interpretation of how a Court of Law would react in their favor. The problem they have is that they are trying to stop the behavior of 57mm+ people. Ever tried to stop that many people? Someone said you can only have Laws which are easily enforceable (or words to that affect). So the RIAA appear to have moved from picking on a few unfortunate little people who coincidentally (how surprising) don't have the money to attempt to fight back so they fold. Now, however, they are going after the easy kill of the big big file traders to the tune of a few hundreds of people. Maybe the RIAA are in the right. That's not the issue for them right now though. These several hundreds of people might well decide to form a group to fight the RIAA in court as a group, rather than individually. And Lawyers being Lawyers someone or some firm somewhere would likely be interested in picking up such a high profite set of clients with all the attendant publicity and media. So will the easy victories work for the RIAA or will they find themselves locked in a monster Court battle? Downloading free music has got to be against the Law? Right? Perhaps, but imagine IF the RIAA somehow lost a major court battle? The ability of music industry to modify 57mm++ people would be even further dimnished. Nope. IMHO this is a blind alley for the RIAA and the music industry. They would far far be better off finding true ways to offer these 57mm people services at great economic value. Rther than trying to sustain their clients activities of gouging consumers who buy CDs at inflated prices. Me? I don't download music (lucky or unlucky me). I used to buy a lot of CDs though, but over time I slowed down my purchases, because I was quite frankly unwilling to pay the exorbitant prices charged by music companies. I wish some Court of Law would turn on the RIAA and ORDER them and their masters to change their restrictive business practises and offer music efficiently and cheapy making illegal mmusic file trading a waste of time. Meantime be careful RIAA, at some moment you might awake the sleeping tiger of little people who might want to bite back. It seems apparent that music buying of CDs is slowing. The RIAA point to this as the reason why muis file trading must be stopped. I think it more likely it's because the music industry is inefficient, full of too many free loaders and needs to get real. And I mean a lot cheaper than Aplle's innovative new service. But at least they are tryng to move in the right direction.

    Bummer: No flip phone which I vastly prefer. and Only 160/160 graphics..I thought that Sony's Cleo etc made 320 the standard for Palm based future devices.... Summary Treo is leaving the dorr wide open for Samsung. Close but no cigar....

    I am obviously not an experrt on this, but I thought that performing in a "public place" to a "group" constituted an environment for which royalties were due? Perhaps someone very knowledgeable can clarify the position. I do believe it is more complex that dmnic suggests. Which is why Hatch needs to listen to the expert advice around him, before spouting off.

    And apparently has received $18K in royalties for his music in 2002. A very creditable achievement for a full time Poitician. I wonder if the Senator has ever played any music at a family reunion, a birthday or perhaps a wedding. Perhaps one or more such occasions has been a public place like a Hall or a Restaurant. On such an occasion has the Senator played music, other than his own and has he fessed up to this and paid the required royalty to the musician or copyright holder of such music? I point this out not knowing the answer to the questions as to whether this possibility has ever happened. But merely to point out that to advocate the BIG HAMMER to smash small people it should work both ways. (People in glass house shouldn't throw stones...etc.) And to encourage the Senator to tone down his his rehtoric and accept the advise of the industry guru's. He might not like the RIAA deciding to pick on a name Politician instead of a kid in college.

    They show upcoming products from OEM manufacturers such as Digitway, iriver, TIO etc. The Digitalway portable HD has me thinking. A minature HD would make a great attachment to a small flashbased mp3 player. I am thinking the flash player could be used at the gym, but when I travel I could hook up a cheap HD. There has been one company trying with such a dual purpose machine, but it's nothing like as practical as one with of these timy drives.

    What we have here is an employer (RIAA) unwilling to take full responsibility for the actions of an employee. Were the RIAA to hire a decent lawyer he would tell them that as the employer they are fully responsible for all the actions of their employees. Hence the RIAA's excuse is pitiful and stereostypically of an organization in chaos without proper executive Leadership.

    Simply amazing that the RIAA with all their highly paid Lawyers is actually run by temporary employees who have the real Power. LOL Are the RIAA for real, trying to blame some temp employee upon whom they gifted the ultimate powers of a Billion dollar organization..... Sort of sets up a defence, I am sorry I didn't actually download these illegal music files, it was done by a temp empoyee of mine who I have fired. Please accept my apologises like yours were accepted by Penn State University or is there one Rule for you and another fo me:)

    Perhaps you should be a buyer, for around $90.00 of the Frontier Labs Nex IIe. For that sum it comes w/o memory but takes any CF Card of any size and any IBM Microdrive. Most of us have a few CF Cards so for less than $100 you could have your dream machine. it's close to mine except it has no FM. Bummer.

Shame upon you SJ. I can see a new IPOD within 15 months when Apple have a war meeting. Of course the new One inch HDs reaching OEMs as we speak with capacity of 1-5GBs will likely launch a whole new range of tiny HD based players starting in July........
