It would be quite simple and lead to greater use if there was simply an arbitration process put in place to prevent infringing use. There is lots of spectrum available and devices are much better at not polluting it today.
The problem with massive deregulation is one of cost however. The FCC (and by proxy the Federal Govt.) makes lots of money from selling access rights.

Another problem with the polls we saw during the Republican convention is that the poll was conducted while a disproportionate number of republicans were at home. Two of the major polls did nothing to adjust for this and the difference in their results verses the other polls was several points.
The other problem I'm aware of is the fact that these polls typically only count "likely voters", usually defined as a person who voted in the last presidential election. There is a massive increase in many states in voter registration, so these people are not counted either. My impression is that they are predominantly non-republican.
CNN clearly shows that gun crime is way down, even Gun Nuts agree that the rate of gun crime is way down, and the Justice Department numbers back this up.
Saying the rate would have dropped anyway is disingenuous as it is totally un-provable. We can't say that the bill prevented crime %100, but we can be %99.9 sure that that is the case.
