There is a major difference between going for a piss during an advert break, and actively removing every single advert. I assume that's what he was getting at.

is there...? suppose i got up to get a drink, hit the john, etc. during every commercial. hard for anyone to argue that i shouldn't be doing that (well, hard for me to see much merit in any such argument). now suppose that my buddy is sitting there in front of the tv the whole time, so he can tell me when the commercials are over, so that i can come back and watch. that's ok too, right? what if we had a big group of, say 50 people, watching and all running off to go get drinks and snacks during the commercial, but my buddy was still watching and letting us know when the commercials were over.

you can see where i'm going with this... i'm not so sure it's a big step from avoiding the commercials on your own, vs having some device (tivo et al) screen them for you, or having someone edit the recording (selective vcr-usage in the least technically-advanced case) to effectively remove the commercials. as i see it, they're all the same coin.

hmmm... while generally i'm pretty annoyed with the whole concept of rider amendments, this sounds like one that i can almost support (subject to the ends-justiying-the-means sorts of quandries). i question whether it'll have any real effect though. since violating the spirit of the law (but not the letter!) with respect to torture seems to be acceptable to the powers-that-be, i've no doubt that some other loophole will be exploited to work around this amendment.

drifting a bit off-topic, i wonder what would happen if someone had managed to sneak an amendment onto this bill (or any other MustPassLegislation(TM)) that made it henceforth illegal to attach unrelated amendments to proposed legislation.

  14. Re:It's a treaty folks... on 'Hacking' To Be Declared Illegal · · Score: 1

And in addition, once a treaty has been ratified it becomes a higher law than the Constitution. Treaties can be used to trump the Bill of Rights, I would expect to see some of this happening soon if it has not already happened.

you're probably basing this on Article VI, paragraph 2 of the Constitution: "This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding." [emphasis mine]

"under the authority of the United States" means that the federal government cannot ratify treaties which demand the use of powers the government does not have. so, no, treaties are not higher than the Constitution, and no, treaties cannot be used to affect any part of the Bill of Rights.
