    If a company demands the traditional Two Weeks Notice, then they should be required to honor it in return. While they can give you payment in lieu of that time, they shouldn't be asking for anything they aren't willing to equally commit to in return.

    Put a link on your page for any viewers who were looking for simpledog.com and arrived at your domain by accident, and don't use any content or logos from his site.

    Trademark The Simple Dog if you'd like. Blogging is enough of a product that you should be able to get one in the same way newspaper names are trademarked.

    I'd look to see how many other instances of Simple Dog or The Simple Dog are currently in use. He may have tried this trick many times and never had any success.

    I don't believe he can easily sue. At least not as easily as he can write you some nasty e-mails. If he wants to go to the WIPO over this, let him. Tell any court that he might file in that they should kick the case and let it be decided where disputes of this type are sorted out, and you're not trying to profit from any of his Good Will. I would guess, however, that his page is doing well for him or he wouldn't be bothering with this at all. Interestingly, your page might drive some additional traffic to his site when people mistype your domain name.

    It might be interesting to know just how long he's had this domain. And if possible, if anyone has ever owned your domain name prior to your own registration.

    Repeating what so many others have said, a lawyer is better than Slashdot for legal advice.

    What I find interesting is how did he find out about your site in the first place? My guess is that he regularly checks his Page Rank and placement on Google, and stumbled over your site having a high(er) ranking, since you actually have content on your page.

    I wonder if asimpledog.com is still available? Or maybe dersimpledog.com.

    Everybody has a right to their day in court.

    Unfortunately, everyone can't afford their day in court - especially against a well-funded adversary willing to spend money wantonly that they know they will never recover from the Defendants. From what I see, in my opinion the RIAA is practicing Barratry, and that should fall under RICO somehow.

    The worst problem here is that nobody that the RIAA is suing is making a penny off of the act of filesharing. In a just society, the RIAA should only be able to collect Actual Damages plus legal fees. The question of the Constitutionality of these exorbitant Statutory Awards - particularly in light of the sending a message context, seeks to punish one person for the acts of 6 million. That's not just!

    I, for one, am not convinced that the RIAA members have ever lost even a single sale to filesharing. I do know for certain that their mantra of: each download = a lost sale is complete and utter garbage, and that they should be sanctioned severely every time they bring up the lie in court!

    the courts are very reluctant to limit access to the courts under any circumstances.

    Try to get those arbitration only clauses in your terms and service, or license agreement, overturned. It was a BFD when the most liberal courts in the nation did finally overturn one such clase as "unconscionable" in California a few months ago.

    If all the "evidence" is revealed at this stage (I didn't see KaZaA screen names in the papers listed, although they should be available in the (possibly faked) screen shots), it should be possible to determine if the RIAA has any case at all this early in the proceedings. Perhaps they can just be kicked out now due to lack of evidence, saving everyone else a whole lot of money, and the RIAA a whole lot of publicity.

    This is the first time that I've seen where someone, most surprisingly an actual non-party, is attempting to require the RIAA to prove their case at this point, where they probably cannot prove it at all!

    One thing impressive about this. Who really wants to find out that the opposition to your case is coming in on the State Attorney General's letterhead?

    Yes, chemicles decay. It's just like food. Leave them around too long and they go rotten. They probably decay to atoms, which if left untouched decay to protrons, neutrons, and electrons. Leave those alone and they'll decay to quarks. Yeah, you've got to stay away from those old chemicles.

    Dynamite decays too. Becomes to unstable that you look at it wrong and it can go off with a big bang! Avoid chemistry sets with dynamite in bottles.

    At the same time that Google started dying on Comcast, so has my Usenet service. It will download a few hundred to a few thousand headers, AND THEN JUST STOP. My newsreader eventually times out and I have to try to get the next batch.

    Comcast is fucking up all over right now.
