Now take this very conservative figure and add in other miscelleneous charges and you could be looking at a lot of time along with an amount of money you could never pay back. These are penalties that outweigh the copyright infringement...not crime. Think about someone sharing 100's of songs and look at what they're up against.
Whoever is charged needs to fight with everything they've got because if we make it easy for them then it'll be a "take a number" mentality of which they will process us like cows headed to slaughter. Maybe this is a new business model? If they we don't spend money on their products then they'll take it from us and actually make more and in the future have much more control.
I'll call it CD-socialism...or maybe CD-stalinism would be more fitting. All of this would also include CD-Mccarthyism to generate fear and paranoia. Since the newer console games seem to be buggier than usual I realized there could be a reason for this happening.
Xbox and PS2 are now network capable and you can dl new content for games and such so what about patches to fix games that were released and will be released in beta or even alpha states? The companies now have this option unlike the past so why don't they use it? Do they already use it? Maybe this is the reason they released their software before it was ready since they have the option to patch it now? I know it's pushed out the door regardless but they should patch what isn't working or accept returns on said games.
I can actually see the day coming where it's a pay-per-patch option only and I doubt people would bitch much. They'd just take it dry as always. It's sad since we have let the power switch to the developers and conglomerates instead of voting with our wallets.
The problem is people buy regardless of the games state i.e. beta state so they have no reason to wait until all bugs are released. Most consumers are conditioned to expect this lack of quality now so they have no one to blame but themselves.
Well if you want to go in true tech style there is a certain amount of gear that you will need to pack. 1) A GPS with visual maps not the ones without them. You can look for favorites within the GPS for cool places to visit plus you won't get loss...unless you're an idiot. 2) An IPOD so you can travel with your pirated/copyright infringed tunes to listen to at will without fear of a RIAA subpoena ending up on your doorstep. 3) Fujitsu Lifebook (built in Wifi) w/dvd player so you can carry around a db of numbers and contacts as well as the very important "Pr0n" for the road (movies, virtual girl, etc.). If you're not traveling with your gf/wife then you're going to need this release! 4) Digital phone for emergencies and/or road ho's you might want to contact you. 5) PDA for instant access to your contacts instead of booting up the Fujitsu. You really do need both!
Now points of interest and in no particular order...Nasa, The Bunny Ranch, Hollywood, Grand Canyon, Area 51, NV, Las Vegas, New York, Roswell, NM, Kenai, AK, Bigfoot Country in Washington/Oregon, Burning Man Festival, Family Values Tour, Tijuana, MX, Astroworld in Houston, TX, Bourbon St, in New Orleans, Scores in NY, and more if need be but that would encompass a lot. You should also stay true to backpacking and only travel on trains and by hitchhiking. What's cool about hitchhiking is when you get a ride and like the vehicle you can just steal it! This should affect Nvidia's stock price a bit. NVDA It looks like it's on it's way down again.
It's pretty amazing how a game can change a companies p/l margins and stock values these days but gaming is a multi-billion dollar industry so it's no joke. If anything Nvidia will come out with a new and better card which I'm sure will be geared towards Valve's HL 2 engine and a surge in sales will follow. Nvidia seems to be on the same course as 3dFX was. 3DFX used to own the video card market but became complacent and had no forward vision. Nvidia came from no where and stole the market and bought 3DFX out. I wonder if ATI will do the same to Nvidia? WHat comes around goes around..
HL 2 is a game that will probably be the biggest ever. I'm talking bigger than Q1/Q2/Q3, Bf1942, and even the original HL. I was never into HL but after the E3 movies I am. The big deal to me is a totally interactive environment. The old thinking or way of doing maps was to have a building made of a box covered with a flat texture. The texture consisted of windows, brick wood, etc.
Now take HL 2 and you have a building with more intricate and detailed textures, with bump mapping (so I've heard), and you can shoot out windows, go into the building and knock over furnishings, hide behind them, throw them at other people, get a coke from a vending machine then blow it up and watch all the sodas fly out from the inside of the machine. I am only scratching the suface in my desciption.
Another big deal is large scale maps with no visual loss of fps ala any quake engine game as well as others. Full facial animation, etc. I'm not sure if they have the body zone damage like SOF but I would think so. You can even duck under a running fan to lure an enemy into that if he doesn't duck it will chop off whatever bodie part isn't low enough.
I wan't to buy this game more for just exploring and the interaction than the gameplay. Take Vice City...even though it was interactive most places were the equivalent of a flat sprite form the doom days. Imagine that game with full interactivity. being able to go into any building, area and having that environment be the equivalent to the real world, materials, physics, etc. and you have a game that is going to take the FPS genre to another level.
Now all they have to do is take the gameplay to the next level...

We are a society of extremely wasteful people. Just look at the way products are packaged these days with all sorts of non-biodegradable plastics with infused chemicals. My parents just bought a set of the gardening gloves but they were packaged in a horizontal manner that consisted of dense plastics. They used to tie gloves in a bundle now they incase them in plastics for loss prevention.
I would have to say a lot of products these days are packaged in a way that's best to reduce theft. As far as technology goes I doubt much thought goes into designing a pc that can best be recycled unless it's already running windows.
I think compartmentalizing the hazardous material parts on any device in it's design would be of some service. That way if you chose not to sell your pc or whatever else you could just seperate the parts and drop them off at a technology device recycling center with a bin for each type of part. We need some of those as I have yet to see one...although they might have them somewhere.
So what I'm saying is in terms of pc's they don't have to design them to be biodegradable because that won't happen. Compartmentalize in an intelligent manner that is best suited for easily recycling the parts because there are a lot of lazy people out there who'd rather throw it away than deal with it.
Hopefully when the disposable dvd's come out they have recycling centers for those and they should be funded by the companies who developed the technology. Those who develop wasteful practices and methods in the days of trying to reduce the problem should be responsible for collecting and recycling their wasteful products.
In all actuality I just hope that consumers reject that idiotic disposable dvd shit but as I said before laziness could make it a massive success. I bet if they throw in a free Big Mac then that would almost guarantee success...

I'm thinking that after Valve's E3 techdemo and their subsequent best of show awards with little mention of ID/D3 that ID were taken off guard. I'm sure they thought they'd waltz in there and floor the place but Valve came out of no where and blew the socks off of everything hands down.
I think ID realized that they would have to revamp somewhat and code additional features into the engine itself as well as enhance gameplay so the worlds would at the very least be as interactive as the worlds in HL2.
I've never been a HL fanboy the movies I've seen of in game play not cinematics are amazing! They have revolutionized gaming and are taking it in a new direction in terms of a fully interactive world. Go dl a movie of HL 2 off Kazaa or BT and see what I mean.
I had no intentions of purchasing HL 2 but after the tech-demo/in game movies I will now buy it.
I know this is all about file sharing and stopping P2P users from downloading copyrighted material but this issue has now transformed into something much larger.
The main issue is now your rights as guaranteed under our constitution. How the hell can the RIAA issue supoenas without judicial oversight? I'm not aware of any govermental department that can issue supoenas on a whim and on an as needed basis at the federal or local level. Our rights in the constitution guarantee us from unlawful prosecution so this RIAA gifted law as madated by paid off politicians is inherently flawed at it's core.
Is it going to take the RIAA busting in your house and holding you at gunpoint treating you as an enemy combatant to realize wtf is going on here? This is bordering on insanity. Prosecuting users at whim with little or no proof and throwing them into financial ruin over an mp3? These aren't the big fish or anywhere near it.
As said previously there is clear and open PIRACY not infringement in many foreign countries and our own where many elements play a part in mass producing cds and dvds to sell on the open market.
P2P is not the black market. It is the sampling pool for future purchasers of the product the RIAA is demonizing into something that is to be resented and despised. I know there are people out there who just dl and don't buy but my experience is most do buy but as our rights are restricted and our choices limited how long will the buying continue?

By continually outsourcing our jobs we shore up foreign economies at the expense of our own. At worse there should be arbitration between the companies and employees instead of moving jobs outside of the US.
I know this is a money issue but the big picture is what's most important. Exporting our jobs along with the technology which goes with it could be more dangerous to our economy than anyone could imagine. We already have technological espionage on our own soil so how is exporting the same technology safer and better form us?
There's also the other part of this argument where your foreign workers are working as slave labor. I thought we were a more civilized and caring society. Didn't Nike and Kathy Lee take it in the ass for having sweatshop workers making their products?

The at home user might dl a divx copy of a currently released film playing at the theaters only to go see it at the theater and/or buy it when it's released on DVD.
So the user at home spends around $9 to see the movie at the theater and another $20 to buy the DVD and the actors take many, many millions in salary to make the movie. How does this constitute taking money from the movie industry?
Who is actually taking the money (actors/marketing) and who is supporting the industry (user/consumer)? This is a very simple question without factoring in the obscene amount spent on marketing films. We're talking 10's of millions in marketing films.
It is not out fault that most movies these days are over budgeted and spend too much on marketing to turn a profit. This almost reminds me of the dot-com business model where they just spent to spend without having a sound business model in place.
Don't blame the consumer for your shortsidedness and/or lack of envisioning a film's realistic chances of making money.
This is definitely the day of scape-goating at the pc user/consumer's expense. They can get creative with the books anymore so now it's time to blame the consumer and spend money in support of the propoganda. Just as music has fewer mega hits the gaming industry will too. There is more music out there than ever before so spreading out funds for music is more pervasive. I think this applies to games. If you look at the amount of games coming out these days, on any platform, you'll notice there are 1000's of choices to chose from. If you own multiple consoles, a pc, a handheld, and have to purchase games for each platform with the same amount of money you used to only buy for one console then you'll see why there are less mega titles.
I'm thinking that if they used Postal 2 right out of the box then the depressed might feel better after playing. Give someone who's depressed a chance to walk freely around a virtual community, killing innocent civilians, causing mayhem within a parade, flame torching elephants, and pissing on all those previously mentioned could be the equivalent of virtual prozac. The obvious plus is lower health care costs as passed on to the consumer...you.

It's nice to see this service starting to expand into indy music. I don't use the service but I support it because it's gives us all another choice. I think if they do a windows version then we'll really start to see an impact. You really can't lose with low prices and ease of use. Even if a person is anti-mac they can't deny that this service will be what the Ipod was to the old school mp3 players. I would also add that I am not a mac user but I can recognize quality no matter where it comes from.

This guy must think we are stupid. First off he says ONE count of copyright infringement and we know whoever is charged will be charged with more than one count. If it's a per song basis like their $150,000 so-called loss then then counts would seem to follow. Let's think small and go with someone sharing 5 songs. Let's charge them with 5 counts of copyright infringement and charge them with a medium figure of 2.5 years per infringement. That's 10 years and a $750,000 so-called loss. You would do less jail time is you beat and raped a stranger and that's just what the lawyer is saying in his encrypted law-speak. Break it down for yourself.
Now take this very conservative figure and add in other miscelleneous charges and you could be looking at a lot of time along with an amount of money you could never pay back. These are penalties that outweigh the copyright infringement...not crime. Think about someone sharing 100's of songs and look at what they're up against.
Whoever is charged needs to fight with everything they've got because if we make it easy for them then it'll be a "take a number" mentality of which they will process us like cows headed to slaughter. Maybe this is a new business model? If they we don't spend money on their products then they'll take it from us and actually make more and in the future have much more control.
I'll call it CD-socialism...or maybe CD-stalinism would be more fitting. All of this would also include CD-Mccarthyism to generate fear and paranoia. It's what we have to look forward to if we don't make our voices heard and stop buying their shit. Since the newer console games seem to be buggier than usual I realized there could be a reason for this happening.
Xbox and PS2 are now network capable and you can dl new content for games and such so what about patches to fix games that were released and will be released in beta or even alpha states? The companies now have this option unlike the past so why don't they use it? Do they already use it?
Maybe this is the reason they released their software before it was ready since they have the option to patch it now? I know it's pushed out the door regardless but they should patch what isn't working or accept returns on said games.

If you're not traveling with your gf/wife then you're going to need this release! 4) Digital phone for emergencies and/or road ho's you might want to contact you. 5) PDA for instant access to your contacts instead of booting up the Fujitsu. You really do need both!

This should affect Nvidia's stock price a bit. NVDA It looks like it's on it's way down again.
It's pretty amazing how a game can change a companies p/l margins and stock values these days but gaming is a multi-billion dollar industry so it's no joke. If anything Nvidia will come out with a new and better card which I'm sure will be geared towards Valve's HL 2 engine and a surge in sales will follow. Nvidia seems to be on the same course as 3dFX was. 3DFX used to own the video card market but became complacent and had no forward vision. Nvidia came from no where and stole the market and bought 3DFX out. I wonder if ATI will do the same to Nvidia? WHat comes around goes around..
HL 2 is a game that will probably be the biggest ever. I'm talking bigger than Q1/Q2/Q3, Bf1942, and even the original HL. I was never into HL but after the E3 movies I am. The big deal to me is a totally interactive environment. The old thinking or way of doing maps was to have a building made of a box covered with a flat texture. The texture consisted of windows, brick wood, etc.
Now take HL 2 and you have a building with more intricate and detailed textures, with bump mapping (so I've heard), and you can shoot out windows, go into the building and knock over furnishings, hide behind them, throw them at other people, get a coke from a vending machine then blow it up and watch all the sodas fly out from the inside of the machine. I am only scratching the suface in my desciption.
Another big deal is large scale maps with no visual loss of fps ala any quake engine game as well as others. Full facial animation, etc. I'm not sure if they have the body zone damage like SOF but I would think so. You can even duck under a running fan to lure an enemy into that if he doesn't duck it will chop off whatever bodie part isn't low enough.
I wan't to buy this game more for just exploring and the interaction than the gameplay. Take Vice City...even though it was interactive most places were the equivalent of a flat sprite form the doom days. Imagine that game with full interactivity. being able to go into any building, area and having that environment be the equivalent to the real world, materials, physics, etc. and you have a game that is going to take the FPS genre to another level.
Now all they have to do is take the gameplay to the next level...
We are a society of extremely wasteful people. Just look at the way products are packaged these days with all sorts of non-biodegradable plastics with infused chemicals. My parents just bought a set of the gardening gloves but they were packaged in a horizontal manner that consisted of dense plastics. They used to tie gloves in a bundle now they incase them in plastics for loss prevention.
I would have to say a lot of products these days are packaged in a way that's best to reduce theft. As far as technology goes I doubt much thought goes into designing a pc that can best be recycled unless it's already running windows.
I think compartmentalizing the hazardous material parts on any device in it's design would be of some service. That way if you chose not to sell your pc or whatever else you could just seperate the parts and drop them off at a technology device recycling center with a bin for each type of part. We need some of those as I have yet to see one...although they might have them somewhere.
So what I'm saying is in terms of pc's they don't have to design them to be biodegradable because that won't happen. Compartmentalize in an intelligent manner that is best suited for easily recycling the parts because there are a lot of lazy people out there who'd rather throw it away than deal with it.
Hopefully when the disposable dvd's come out they have recycling centers for those and they should be funded by the companies who developed the technology. Those who develop wasteful practices and methods in the days of trying to reduce the problem should be responsible for collecting and recycling their wasteful products.
In all actuality I just hope that consumers reject that idiotic disposable dvd shit but as I said before laziness could make it a massive success. I bet if they throw in a free Big Mac then that would almost guarantee success...
I'm thinking that after Valve's E3 techdemo and their subsequent best of show awards with little mention of ID/D3 that ID were taken off guard. I'm sure they thought they'd waltz in there and floor the place but Valve came out of no where and blew the socks off of everything hands down.
I think ID realized that they would have to revamp somewhat and code additional features into the engine itself as well as enhance gameplay so the worlds would at the very least be as interactive as the worlds in HL2.
I've never been a HL fanboy the movies I've seen of in game play not cinematics are amazing! They have revolutionized gaming and are taking it in a new direction in terms of a fully interactive world. Go dl a movie of HL 2 off Kazaa or BT and see what I mean.
I had no intentions of purchasing HL 2 but after the tech-demo/in game movies I will now buy it.
I know this is all about file sharing and stopping P2P users from downloading copyrighted material but this issue has now transformed into something much larger.
The main issue is now your rights as guaranteed under our constitution. How the hell can the RIAA issue supoenas without judicial oversight? I'm not aware of any govermental department that can issue supoenas on a whim and on an as needed basis at the federal or local level. We already have technological espionage on our own soil so how is exporting the same technology safer and better form us?

The at home user might dl a divx copy of a currently released film playing at the theaters only to go see it at the theater and/or buy it when it's released on DVD.
So the user at home spends around $9 to see the movie at the theater and another $20 to buy the DVD and the actors take many, many millions in salary to make the movie. How does this constitute taking money from the movie industry?
Who is actually taking the money (actors/marketing) and who is supporting the industry (user/consumer)? This is a very simple question without factoring in the obscene amount spent on marketing films. We're talking 10's of millions in marketing films.
It is not out fault that most movies these days are over budgeted and spend too much on marketing to turn a profit. This almost reminds me of the dot-com business model where they just spent to spend without having a sound business model in place.
Don't blame the consumer for your shortsidedness and/or lack of envisioning a film's realistic chances of making money.
This is definitely the day of scape-goating at the pc user/consumer's expense. Just as music has fewer mega hits the gaming industry will too. There is more music out there than ever before so spreading out funds for music is more pervasive. I think this applies to games. If you look at the amount of games coming out these days, on any platform, you'll notice there are 1000's of choices to chose from. If you own multiple consoles, a pc, a handheld, and have to purchase games for each platform with the same amount of money you used to only buy for one console then you'll see why there are less mega titles.
I'm thinking that if they used Postal 2 right out of the box then the depressed might feel better after playing. Give someone who's depressed a chance to walk freely around a virtual community, killing innocent civilians, causing mayhem within a parade, flame torching elephants, and pissing on all those previously mentioned could be the equivalent of virtual prozac. The obvious plus is lower health care costs as passed on to the consumer...you.

It's nice to see this service starting to expand into indy music. I don't use the service but I support it because it's gives us all another choice. I think if they do a windows version then we'll really start to see an impact. You really can't lose with low prices and ease of use. Even if a person is anti-mac they can't deny that this service will be what the Ipod was to the old school mp3 players. I would also add that I am not a mac user but I can recognize quality no matter where it comes from.
