A prospective client called and asked whether the Florida homestead protection extends to IRS debts where the IRS debt pertains to one of the two spouses who own the homestead. While Florida's homestead is a broad and strong asset protection shield, it does not offer full protection against IRS taxes. The IRS can put a lien on homestead property to collect taxes. While the IRS cannot force a sale of the residence to collect taxes, the tax lien would remain a recorded encumbrance, and whenever the house is sold, the taxes, plus accrued interest and penalties would have to be paid before the homeowner received any sales proceeds.
What works for one Federal agency should work for all of them. So if the SEC or a Federal Judge placed a lien on the property, it may not be collected, but if he sells the house, it would show and then have to be paid, or the sale would not proceed. He's screwed, if I understand that correctly.
For example, even Florida's homestead protections cannot avoid a lien placed on the house related to criminal or egregious activity. Secondly, federal agencies have unlimited resources to attack lawyers who attempt to deceive the agency or collaborate with targets of their investigations. Targets of federal civil or regulatory agencies are "toxic clients". Its not worth it.
From: Florida asset protection It may just be that the Feds could take whatever they own, regardless of the state protections.
There are some laws here in Florida that protect homes from confiscation (a homestead law). From what I understand of it, it only pertains to liens from within Florida, not a Federal lien. I'm going to do some more checking and read the laws to see how it may or may not pertain to this ruling. Let's hope Ralsky joins the ranks of the homeless, and soon:)
When I submitted this news item last night (rejected, of course), I had posted a related link. Apparently Ralsky is also in trouble with the Securities and Exchange Commission regarding a fraud scheme

The rest to 100% total are Mozilla, Opera, etc. Firefox didn't show up in the list until October at 2.4 %. It will be interesting to see how it goes after this NYT ad.
The idea as written will remain insane to you until its your child being molested.
If you think the idea is insane, remember we're talking about a pedophile. Wander over to NANAE sometime, and check out the posts with suggestions for dealing with spammers, an obviously lesser crime than child molestation. In particular the thinly veiled threat to firebomb the same NOC that houses my servers. There were some spammers leasing rack space in the NOC, not connected in any way to myself, and the problems had been dealth with by the hosting provider.
Come on now, think about it. I didnt mean a "knee knocking" jolt, just a tingle. But there are other variations that could be done such as sending a signal to the police, similar to the tracking ankle bracelets worn now by some home confined felons.
on the ankle, similar to the tracking ankle devices, and that would give a shock every time the person is near a computer? Surely there has to be some low frequency emissions from computers in general that a device can be tuned to, producing a reaction.

The CNN story I had linked has the following:
"accused of misappropriating Internet addresses of the state Senate and more than 60 Pennsylvania businesses to sell fake degrees and prescription drugs by spam e-mail"
And:
"Prosecutors said more than 18,000 illegal e-mails were sent out this year with links to Trinity Southern's Web address, including 300 that appeared to originate from the Internet servers of Pennsylvania companies and institutions."
The Pennsylvania companies and institutions are also victims.

I also sent this in when it was announced, and was rejected. I had earlier sent in a related story regarding a proposal to put "uniformed" police in chat rooms and IRC channels, and the reaction by IRCops and administrators, also rejected.
Other stories I've submitted have been rejected, but that does not stop me from submitting, although it is frustrating at times. I try and choose the chat related stories that would of be of interest to the Internet community in general, and not just technical stories geared toward active IRC operators.
Don't get discouraged by rejections, it happens to all of us. I do want to thank you for taking the time to submit a story:)
Here's another thing I just ran across in their site, under Questions.
"Can I delete my logs?
Yes. You can delete your chat history at any time, and we'll erase it from our servers as expediently and thoroughly as possible. (We try to make it pretty clear that you're doing this so you don't end up deleting your logs by accident!)"
The words "expediently and throughly as possible" really make me wonder. I want to have control and a guarantee of what I delete, which means I'll archive my chats on my own system, thank you.
There really isn't anything to prevent them from using the logs in a similar fashion to the out of control cyber-vigilante web site Perverted Justice other than a privacy policy that seems to leave a lot of questions in my mind as to the security of the system.
According to their privacy policy:
"Access to your personal information other than your chat logs and buddy lists (which are protected according to Section 2.3) is limited to employees who reasonably require access to it in the course of doing their jobs, such as providing customer support to you. We require those employees to sign confidentiality agreements promising to safeguard your information."
There's been a few highly publicized cases of insiders stealing information. I've got to pass on IMSmarter.
Thanks for that information too. About your site, can you send me some information so I can add it to our software guide? Basic description, features, etc. It looks like something our viewers would be interested in. You can send it direct to my email address. Thanks, Pete
Thanks for that clarification. I had only done a quick search. What I was thinking is that if this story is true, then it would make sense that Tivo would be exploring other sources of revenue. I'll put Tivo on my stocks to watch list and see how it goes.
This move seems to be a result of the hard stock price drop which occurred between March and September of 2004. I've always thought of corporations as one of those huge Euclid off road dump trucks with the 12' tires, and no power steering.
Android, I figure you have your posts on notify if there is a response, so you should get this. What happened to nanae, nothing but junk messages there. I'm going to guess its "moris". He's emailed me a few times with some bizarre emails, I've ignored each of them, but I did keep them. I did manage to get his real IP, if it would do anyone any good.
The resignation was written November 2nd. Election Day. You're right, this is a custom that's been going on for many years.
In this case, I think it to be true. I just saw it on CNN'S site. It mentions some remarks by President Bush in regards to the resignations of Ashcroft and Evans.
Here's another item I missed from the same site:

Maybe they can go over to Homeland Security and borrow duct tape and some plastic.

A related proposal, involving "uniformed" police to monitor chat rooms, was announced June 9th 2004 Cyber Cops to Patrol Internet Chat Rooms We polled over 100 IRCops and Server Administrators and posted the results at: Chat Network Operators and Users Wary of Uniformed Police Presence

Hi Mark,
Thanks for that clarification. I had only done a quick search. What I was thinking is that if this story is true, then it would make sense that Tivo would be exploring other sources of revenue. I'll put Tivo on my stocks to watch list and see how it goes.
Doing a bit of digging, I find that Tivo is a public company. Some information on them:
Company Profile
Company Two Year Stock Chart
This move seems to be a result of the hard stock price drop which occurred between March and September of 2004. I've always thought of corporations as one of those huge Euclid off road dump trucks with the 12' tires, and no power steering.
Then hammer them with advertising. Its the american way :)
Thanks for the reply. I use google to get in and it shows only the flood messages. Don't have a news server, I got enough to handle without one :)
Pete
