Team up with a bunch of laywers to tackle anyone who uses the patents without permission (no win no fee)
And fight, head-on, the bigger organsiation
The monies from licensing fee can then be used to develop/promote/move forward the OS community
Look the OS community has proved that we can write good software and fight hard when we need to. We have also shown that we can organise disperate people in various places, timezones, languages etc. and form them into a very effective development team. Now why don't we do the same for patents and a) protect ourselves and b) fight back!
Hell if anyone else is interested in helping I am more than happy to try and setup the organisations (UK or worldwide), e.g. do the leg work, talk to people etc..
Serious question time but in the culture of "litigate like mad", where do we stop?
This porn company is sueing bacause of copyright infringement, what next do we sue Google for next; because if you search for something you wrote, and someone else has stolen it without using your copyright (e.g. some software I wrote), or the GPL is being violated, etc... Then we *must* sue google for this crime. Do we have to appoint someone to check *every* google link?
If it is found that google is guity, then they have aided and abetied a crime.
Consider *any* terrorist who uses google to search for the group to join, who then go on to commit a 9/11 type attack. Do we sue google for aiding and abeting mass murder? Are the directors *personally* liable? Are the staff? Are the shareholders? Does the US put on trial, and if found guily, execute a few hundred/thousand/million people for their "part" in this crime? Or what happens if another school mass killing is found to have occured and the people who carried out the act used Goggle to find out information, or to find an ammo supplier etc..
Where do we draw the line with stupid litigation? When will people stand up and take responsability for *their* acts, *their* incompentances, *their* failings, rather than blaming others. Or when will the correct people be blamed for *their* acts rather than trying to off-load the blame onto others??

Current job (education) is paying (with lesson prep/marking etc..) less than the minimum wage, with threats from students, bad management, and very little life (doing 12 hour days of teaching inc weekends, no no really). So back into coding for me.
1) What do they mean by "shipped"? is this only the units sold by people like Redhat, IBM, etc.. Or does it take into account all the versions of Linux download and used? With Windows its easy to say "I have sold x many licences, therefore there are x many servers/users" but with Linux you cant - the numbers are likely to be a lot higher.
2) It's nice to see the SCO lawsuit had such a dramatic effect that the total number of unit of Linux sold has risen. 30+Million dollars of MS^H^H SCO/Venture capital money burnt, with no tangable benefits - other than cementing linux place in the world of IT.
I wonder how worried MS really is about this?

It could be worse, much worse, but the present system of politics dominated by large corporations, almost buying their way (or their cronies way) into power cannot be good, in the long run, for the average Joe on the street
