    Two interesting points:

    The longest quote used was 2 paragraphs "from the end of the article." They don't say how long of an article though.

    The article writer attempts to address fair use but just happens to leave out the "for the purpose of comment and criticism" aspect.

    That's exactly the problem. People "excerpt" the body of the article (change the headline and omit the byline) without reference or attribution in their "blogs" all the time.

    That does not appear to be the case with The Drudge Retort (the site being DMCA'd). The site appears to have a link to the original story and a short summary. I am not familiar with the site though so maybe they are talking about a different section.

    You would be investigated, but if the only evidence presented at the case was the odd behavior you would be found not-guilty. The MPAA/RIAA use the odd behavior as not only the probable cause to investigate but also as the evidence to prosecute.

    You are indeed correct. However I own the copyright to the content thereof, and your recording would be a derivative work of my speaking.

    That is incorrect. Copyright only covers fixed media so your speaking is not copyrighted until it is fixed, in this case onto tape or something. Now, if you were reading from a published manuscript that would be different and would cover your example of the original songwriter.

    Let me know when a US citizen is placed in jail or killed for anything like a blog.

    The MPAA was granted an injunction against 2600 magazine over a link to DeCSS. Failure to remove the link would have resulted in contempt of court charges that would have led to fines and/or jail time. Censorship absolutely occurs in the US it is just for different reasons that Syria.

    That doesn't benefit Apple. And once again, Apple didn't want the DRM it is only a burden on the company. But the labels insisted.

    Again, the only evidence you have that supports this assertion is what Apple says it wanted. This despite the fact that the DRM is obviously adavantageous to them.

    Compared to the other DRM schemes being used or proposed for music at the time, Apple's Fairplay was actually a lot more customer-friendly. It was like a fluffy kitten compared to the vicious DRMs the studio execs wanted. And Apple had to fight to get that.

    That's what they say they did. Meanwhile, their DRM scheme had comparable restrictions to the other DRM systems available at the time.

    I'll grant they can stay aloft longer. But I question the "cheaper to operate" if you figure totally amortized costs for the plane, the maintenance, the bunker for the pilot, the satellite, etc.

    A pilot in a bunker is a pilot not in the vehicle. So subtract the weight of the safety equipment and the weight of the pilot you should see quite a reduction in fuel costs.

    Apple was upbraiding the record industry execs for a good three years during and through the Napster debacle. Apple was telling them that customer-hostile DRM that took away obvious and visible consumer rights wouldn't work...

    That's what they say they were doing. Meanwhile, they were implementing customer-hostile DRM that takes away obvious and visible customer rights.

    When you create a work, you also maintain and keep the moral rights to the work. That basically means that another person can't modify the work.

    WRONG! If I buy a book or a CD I can do ANYTHING I want to it except copy/re-distribute. I can make a paper mache puppet out of the book or a coaster of the CD and there is no "moral right" preventing it.

    IANAL. I just know the difference between copyrights, trademarks, patents, industrial design, and trade secrets.

    There's an example where a sculptor created a flock of geese in a mall for decoration. For one Christmas season, the mall tied ribbons around the necks of the geese. The artist sued the mall and won, because it violated his moral rights to the work.

    You could walk in, copy the recipe and cook your own McMuffun though...

    The platform is still pretty useless to the application developer, the artist, the musician, the scientific researcher, etc..

    Python runs on Win CE so it works for this developer.
