I'm not really worried about patents like these because I feel that the whole patent issue is coming to a head, and that in the end, things will change. Silly patents will not even be contested in court, and many will be tossed out for sheer sillyness.
I live in Washington State (USA). Here we have the state capital of Olympia, Olympic mountain range, and not to mention America's finest piss water, Olympia Beer. A few years back, the Olympic Committee sued several businesses in Olympia and around the Olympic mountains for using "Olympia" in their name. I can only suspect that Miller Brewing, which owns Olympia Beer, paid them off, but the rest went to court and more or less lost.
I see Google turning into a useless advertising poisoned portal someday which takes an hour to load on a DSL connection and doesn't work on anything but MSIE.
And by that time, Brin and Company will be long gone, and someone else will have perfected the ultimate search as a Ph.D. project, then spin it off to a privately held company, only to fall prey to the allure of money and take it public and walk away richer than Bill Gates while the company becomes a profit driven IPO...

I think that like many multi-nationals, AOL thought that OSS / Linux / Microsoft alternatives would never take off, that Microsoft would vanquish the evil free-software-movement. I think that they have decided that might not be the way things go, and they want to be still in the game.
Missed expectations? That may have to do with your gif patent expiring and your corporate pigs getting their snouts pulled out of everyone elses troughs.
Many here may be pissed about the GIF issue, but UniSys's finantial situation has neither gained nor lost because of it.
Open Source defiantly means free money to some of the "Capitalist Pigs" that fold parts of it into proprietary commercial packages or bundle apps with proprietary commercial packages. There are without question commercial companies abusing the GPL / BSD licenses. Of course, while one might suspect, it can be difficult to prove.
