You might want to look at the UCITA before getting too sure about an EULA not being in force due to first sale or informed consent. Virginia and Maryland passed versions of this act, so a software vendor could, for instance, attempt to use Maryland courts to enforce its EULA. Some states have passed "Bomb Shelter" laws to prevent this. Check out: http://www.ala.org/ala/washoff/WOissues/copyrightb /ucita/ucita101.htm for more info.

Unfortunately, it doesn't say that. It says: "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed." By mentioning both a "militia" and "the people" it becomes ambiguous.

I have to disagree on this one. Interpreting common law cases can be some of the most difficult work performed by an attorney. In the US, it includes all statutory and case law background of England and the American colonies before the American Revolution. Common law is not the opposite of civil law but rather of current statutory law. It may include civil as well as criminal components. It most certainly is not simple.

Earthlink does NOT sell their lists. I suspect that the email address was taken from my Earthlink home page.
