One of the benefits of Apple having such a huge cash hoard is that they can offer such bonds, a luxury other companies don't have, and potentially one of the factors that make Apple so much more likely to ask for bans.

Does that include cases that are dropped or plea bargained? I would guess that unless they were sure of a conviction, or it was a high profile case, a DA would try to avoid a trial. Trials cost a lot of money, and a DA would probably like to plea bargain any case they aren't positive about. And the accused may be willing to plea bargain even if they are innocent, just to get it over with.

Therefore, Apple does not need to check for a previous install, and does not need the draconian checks that Windows has on upgrade versions, and will happily install itself on a clean hard drive. This provides a much better user experience, without having to prove that the older version exists, either with license keys or checking for an old installation.
Secondly, even if it required a previous installation, you could restore the original version from the recovery disk, and then install the new version. So, in no possible way could this be construed to be your scenario.
Consider this example: I have a Mac with OS 10.4. I buy a new hard drive, put it in, and install from my shiny new OS 10.5 DVD. Knowing that this is a mac, and therefore a previous version of OS X must exist, 10.5 happily installs itself. I also have a PC with windows XP. I buy a new hard drive, and install vista from my shiny upgrade DVD. Before Vista will install, I must prove that I have a valid XP license. I must either put in another license key, or let it install over the old XP system. Now, which system sounds more user friendly to you?

Imagine telling your computer to read you the article, and not having to wait for it to work it's way past the navigation bar. I agree. My school actually has a class just like this. One professors plays the role of the customer, and gives us a vague description of a product that he wants. We are then left to organize ourselves, deal with version control, figure out project management, etc. Depending on the year, you either start out with a previous class's project and extend it, or start your own project. The class works very well, and we have a number of corporate sponsorships.
Has there been any study on the impact this causes to the ocean currents? Could too many of these cause the current that keeps Europe temperate to stop? I doubt one plant will have that much effect, but I worry about the people who think that just because there are no emissions, there is no effect on the environment. That energy must be taken out of something.
