The EULAs for Office 95,97,2000,XP and 2003 don't even mention what you run the software under, let alone forbid or require anything. Since they don't promise support the only mention of support is that any software provided by their support is also covered by the eula.

As to "No-one, and I repeat NO-ONE has ever died for a flag."

I would say that that is incorrect, until armies stopped carrying their battle standards (usually flags, one of which would normally be the nations flag) into battle, they often died to protect or capture those flags.

It could however be argued that they were dying for the pride of their regiment, or perhaps if they were intellectual for the morale effects, but I suspect at least some would have quantified it as "for the flag".

http://www.zeldman.com/ - Darkish Green on Light Green poorly readable colours. No sitemap. Unclear section titles, alt text no better.

http://www.joeclark.org/ - Bigger than users chosen size text (as every thing is in lists) makes page too long. Use of non-standard 8-bit characters. No Sitemap.

http://www.webstandards.org/ - No search. No sitemap. Otherwise OK.

http://www.alistapart.com/ - No sitemap. No contents or short titles list in each section, you have to "More articles->" 10 at a time instead. Instead of link "Home" it is "Up Front" (Never heard of standard practices?)

The ALA site publishers include Zeldman, the Zeldman site contributors includes Joe Clark, the web standards site former major people includes Zeldman. The AC probably just likes this circle of styles, but on the other had maybe he is Zeldman himself? ;-)

I can think of a possible case that it a lot less fantastic: There is a hijacking; the sky marshal and the hijacker kill each other. One of the passengers panics and tries to escape by opening an outside door whilst you are still at 30000 feet. You see this panicked person and yell "stop him" pointing at him but no one near him hears you. You are too far away to get to him to stop him. But you are next to the body of the sky marshal or hijacker. And their gun. Leaving it to the last possible minute, yelling all the time, you pick up the gun and shoot the panickee (you are a good shot so know you will hit him and not puncture the wall of th airplane). It might not qualify as self defense as you could survive just by strapping yourself down and using the emergency oxygen (and you thought of that). It should be argued that you were stopping a manslaughter. What if the panickee opening the door was a 40 year old that has a mental age of 5 and had no possible conception of the results of his actions (and you know this person well)?

It is possible that the term would have needed to already been struck down for their actions to be illegal at the time.
