It depends, IANAL, but if the origianl user was sharing it throught the Zune service, when he started the process, his copy that he provided to be shared was unaltered which is consisitent with the CC.
As part of the service, Microsoft's software (which is owned by microsoft, and only licensed to the user (read your EULA)) added the layer, (more likely making a copy of the song in the process) and create a derivative work based on it. Since the Zune Software (which is Owned by Microsoft) made the alterations and copies, not the the end user, I would argue it is Microsoft who is ultimately responsible here.

I don't think the "OS 2 tried that" argument holds as much weight here. At the time, both systems were vying for desktop dominance and they didn't have years of legacy code support to worry about. Apple does not allow them to sell there products for less then what Apple says, and they make very little profit on notebooks. (in the range of 10-20) so you're friend was STEALING from his employer.
Compusa and Best Buy make their money on the overpriced accessories, like $39 dollar USB Cables. Every Compusa in my area sells the same monster crap cables for 39 dolars. Sure Business service can order me a different brand for $7 but it has to be shipped from their warehouse, they don't carry them in stores.
OK, here's a serious question. When a company hires an H1-b visa holder, are they required to pay unemployment insurance on this worker? I don't know the answer, but the logical one would be no since the State would not (in my mind) end up having to pay any claims as the worker has already a) left the country or b) found another job. What about the other voluntary costs companies incur as part of retaining workers, such as Health insurance, retirement etc. It would seem to e even if a company honestly was paying an H1B the same as citizens, they could still create great cost saving in not proivding the supplemntal costs that go along with attracting and retaining workers.
