    Novell is making a huge mistake by attempting to shove a Desktop down the throats of consumers and businesses. Some like KDE and others like Gnome it is the purchaser that should have the choice.

    See the Barbie lawsuit. A singing Group, Aqua, produced a paraody Barbie song and sold the song on a album. If the producers of this cartoon had simply used the original lyrics in the song there might be something to their claim.

    But when they have Bush in the toon say "the right wing nuts" you now have a paraody of the song.

    The copyright holders could end up paying any defendent lawyer fees after the Mattel v. Aqua decison by the Supreme Court.

    Through the DMCA notice procedure the MPAA could have had the web site taken down and if the man kept offending the MPAA or creators of SG1 could have had a injunction slapped on this person. But what is really going on here is FBI Agents, DOJ and MPAA are putting another notch in their belts.

    If he gets twenty years for copyright crimes then the US taxpayer gets to pay $30,000 a year to house him in pirson. Not to long ago a man in Wisconson was sentenced to eight years in federal prison for playing on a police radio on halloween. I swear to god our government is out of control and I'm about to join Keith Henson in Canada because America is becoming a police state with the war on terror, drugs and now copyright infringement.

    What good is the first amendment when if you commit a civil tort the state criminalizes it and puts you in prison for copying a f**ing movie or a book?

    If you buy their UNIX or Linux Product later on down the road they will read something in a license agreement and file suit against you like they did with IBM, Autozone and Chrysler. Their legal actions are similar to Ford Motor company suing people that buy their SUV's for painting their cars or repairing a tail light. Business by litigation is always bad for corporations that need customers to buy their product to survive.

    Yes, The biggest one that worked very quickly was when Adobe assisted the FBI in the arrest of a Russian programmer because he talked about DCMA circumvention in a public place in Las Vegas. The effect was so bad that Adobe stopped assiting the FBI and the later the FBI deceided that they would lose the case on appeal because of the First Amendment, they later only prosecuted the Russian corporation. I don't think this boycott is effective and will not last more then 1 day. Besides I like the anti-linux ads, they give me a chuckle.

    They will have to collect 911 taxes, Federal Taxes and buy business licenses. While VOIP may be nice if there is a power failure everyone with a desktop will be offline and the cell phones will become quickly over loaded. Even during the recent black out in the NE USA the local telephone service worked flawlessly. ISP's will need to have reliable backup genarators which are not cheap to buy and maintain.

    The laws have changed in the last year. ID theft can lead to a long prison sentence especially if you have a prior felony conviction. The Buffalo Spammer already had a federal conviction for fraud over $10,000. For first time offenders there is always diversion programs, but once you go above $10,000 and you have a prior conviction they now throw the book at you.

    If you used a licensed MS product that qualifies you are eligible. I live in Oregon and I just provided proof of my employment and temporary residence address to prove my claim. If you ordered a PC from California you do not qualify or if you did not reside in California for more then 10 days. To boost tax revenues if you are in California for any business purpose you become a resident under California law on the 10th day of arrival and luckily I still have my California tax papers work from 1996 ;-) Although it is not required I'm sure those outside the state will get the most scurtiny, so documentation or a letter should help out.

    Herb is just writing a OP-ED piece for the trial lawyers association. Notice the "same law firm as the tobacco companies" dead agent attack. People die of cancer all the time that don't work for IBM and I'll be damed if I will believe the scientific analysis of a man paid $100,000 for testifying in each of those civil cases. It is all about the money and the trial lawyers will get 40% of the take if their client(s) win or settles and I'm sure Herb has some financial ties to this case or the lawyers involved. The difference between the NY Times and the Weekly World is that one of them is supposed to be objective and lately it appears the WW has more credibility.
