    Zelda is out. Mario is out. Metroid is out. Eternal Darkness is out. Rare is gone (only worth mentioning since Goldeneye was the killer app for N64).

    WHERE IS THIS KILLER APP GOING TO COME FROM NOW? C'mon people, lets try to live in reality.

    I think its pretty clear there isn't a development house out there that actually knows how to prepare accurate milestone and release estimates.

    The most obvious examples are so well known, and deal with the largest developers out there, so that I am not going to name them here.

    Suffice to say, without these "evil" publishers, I doubt any game would EVER get released.

    Why didn't you quote any of the parts of the article about timing? Oh wait, because that would make your point untrue.

    If, 2 years before release, a feature is expected to be in the game, then at the last minute is cut, thats not false marketing. Actually, its not even lying. Its just being incorrect. One can be incorrect without having malicious intent.

    Now, if the day before release a feature is promised that is definitely not in the gold released product, that is all of the above and then some.

    In summary, like you intentionally ignored, its all about timing.

    Based on the screenshots, the female character appears to have been modelled with exceptional attention to detail. The collar bones are well done in relation to the overall look of the game. The breasts appear to be perfectly placed as well. Though in that case they appear placed where a plastic surgeon would place them as opposed to nature.

    This is what passes for insightful these days? I bet it would be prohibitively expensive to ride a horse instead of a car. A car would end up being cheaper after all the costs are added up. No matter how you slice it, these devices will cost more than scantrons. Especially once the kids start breaking them.

    It IS worth considering if the application is worthy and practical before proceeding. I mean, lets just say I'm the type that will do anything to get out of a test I'm not prepared for. One moderately powerful magnet should be able to delay things for quite a while, and at quite a high cost to the teacher vs the difficulty in implementing the hack. And it would be a while before anyone could figure out what happened.

    I'd say stick with Scantron for now. This technology may be viable some day, but that day will likely be when the cost is so negligible that cost won't be considered in the discussion. Hey, that sounds like the cost of scantron forms!

    Just to be clear on what you are saying here because it flies in the face of the common slashdot perception about licenses...

    If this point 5 of the GPL is allowed to stand regarding License (contract) acceptance, it would also mean all those other software licenses that you passively (or actively) accept also will be legal and binding. Modifying or distributing code is a much more passive act, with respect to contract participation, that actively clicking a button that says "Yes, I accept the terms and conditions of this contract."

    Strangely, the converse does not really hold true. If this clause of the GPL does not hold up, it doesn't necessarily mean all the EULA's of the world are struck down since those actually require more active input to get past and use the software. Also the logic the author chose to build into point 5 is flawed. As with any other instance of copyright, a potential user has 3 choices: 1. Not use the copyrighted work, 2. Use the copyrighted work according the license, 3. Use the copyrighted work beyond the boundaries of the license without permission. A license cannot retroactively deny choice 3. Its still a choice, albeit illegal. This is what copyright law is for, but one can't use that law to deduce as point 5 does that one has entered into a contract. The potential ramifications of that are astounding.

    Lets be careful what we wish for here slashdotters. We need to decide if we are for passive software license acceptance, or against it. I vote against.

    I agree 100% with everything. I have never been interested in MMORPGs because of many of the problems listed here. There is not a significant amount of Role Playing going on in comparison to the power levellers. The incentive is to go out and get ph4t 1007 rather than role play.

    This would raise one serious social issue however. It has already come to pass that individuals have commited suicide over what transpired in the game world. Would perma-death cause this to be more likely, since the character (and ph4t 1007) the real world person is attached to has died? Or would this make the games somewhat safer for the real world person because the character will definitely die at some point, thereby preventing too strong of a player-to-character bond?

    My prediction: The world will never know. The call for perma-death will always be drowned out by cries of, "OMFG n00b I w1ll n3v3r play j00 sux0r MMORPG. I \/\/an7 ph4t 1007!"

    The problem with coming up with a current example is that anyone with that information would still be working at a game company, and thus be in violation of any NDA's they are under by revealing that information.

    If one wants to discover the information they could simply by comparing a title to its N64 or GC port. Examples are out there.

    Now here's the real trick. Anyone with a Gamecube is probably a Nintendo apologist, which is fine, but this person would not be inclined to report any information that could reflect negatively on the Big N.

    Games are no different than any other medium. If someone wants to archive them, open a library or museum. That individual would buy an individual copy off ebay (accept donations, find them in the attic, etc) then archive it under the fair use rules provided for libraries and museums under copyright law. They could legally make backup copies for archival purposes to avoid bitrot. Think microfilm and magazines. They can allow people to come into the museum and play the games. They can even loan out the legally aquired instance of the game to other people in the same way a library checks out a book. If any individual on /. truly cares about this issue, that individual should do this. Sounds like a genuine not-for-profit business opportunity in this weak job market. Outside of that, this thread is about justifying copyright infringement, and I'm not buying it.

    I dont appreciate them listing new vehicles as new features. From my experience with BF1942, the vehicles are no more than one of the features of the map it is in. Correct me if I am wrong, but its not as if the admin can drop the jet pack in Wake Island now. This goes for the character models and available weapons too, all map dependent. They might as well list the new types of buildings as features. I have serious problems with the concept of expansions in relation to BF1942. It seems to me that it would be more appropriate to call them map packs since that is all they are. They make the game intentionally difficult to mod, then release extra maps and call them expansions. FU too EA.

    Except with Windows, on a PC not connected to the Internet, a new user really can't hurt anything AND can get alot done just by randomly playing around. In this thread about Windows user's expectations, it should be made clear that if a new user can't safely get in and play around, the whole damn thing is annoying or worse to that user. I'm not saying under certain conditions a new Linux user couldn't, but overall "obviousness" is important and should not be discounted. Your dangerous and sadistic proposal is really out of place. Does a simple calculator require training to use effectively? Likewise a user will expect the same from a PC.

    Except every big game has supposed to be the one that boosted GC sales through the roof, and they haven't. Metroid was a blip in turns of being the killer app*. Mario and Zelda both failed as killer apps as well. (PLEASE PLEASE DO NOT MOD THIS AS FLAMEBAIT, I AM NOT SAYING THEY ARE BAD GAMES, MERELY THAT THE NUMBERS SHOW THEY WERE NOT THE KILLER APPS THEY WERE EXPECTED TO BE, now back to the point I was making...) Why are we to believe that Mario Kart is going to do what Mario, Zelda and Metroid continue to fail to do? Metroid and Zelda, two of the supposed killer apps, are now among those that you can get FREE with the system and it still has not created a sales skyrocket.

    *Killer app: The single piece of software that people buy the system to use (see Goldeneye or Halo). A game or application peceived as so desirable that it alone sells systems.

    So if I may summurize your above post...

    You aren't too good with hardware since it was pretty easy to use the network adaptor with PSO for Dreamcast.

    You will readily buy the network adaptors for PS2 and GC despite a lack of software, but would not buy XBOX Live because of a lack of software. Interesting logic. Again I wonder why I even bother to deal with this.

    I think the revolutionary new product will be the Game and Watch SP. Exactly the same as the original Game and Watch, except now it doesn't take replaceable batteries. The SP version will also include a hinge that is designed specifically to go bad and artificially shorten the life of your Game and Watch.

    Or maybe its the Virtual Boy SP. Just like the original, but its backlit and comes in a variety of colors. The shoulder buttons have also moved from the controller to the back of the visor. You also have to choose between plugging it into the wall or listening to the sound.

    All you fanboys don't forget to upgrade your G&W and Virtual Boys to the SP models immediately.

    Oh Painkiller you known fanboy. You would buy a Gamecube network adaptor? To play PSO then? Well you CAN play PSO on XBOX Live. To recap, you would play PSO on your Gamecube but not on XBOX. The logical fallacy is delicious.

    WOULD buy the Gamecube adaptor despite the fact that it has no games, won't buy Live because it has no games (though it has all the games GC has plus many more). I can't stand to read your nonsense anymore.

    A valid point here is that you can't really stack a DVD and Gamecube since the Gamecube wasn't designed with Americans (outside of fanboys) in mind. Opening from the top is pretty silly in this age of home entertainment centers and the uniquely tall size (especially with the GB player) make it unsuitable for most standard entertainment centers.

    This is a fatal design flaw to me. If it won't fit with the design of my house (a pretty standard American design) why would I buy it? PS2 and XBOX own on that point hands down and going away. More proof that Nintendo has nothing but contempt for Americans.

    Hey you know where it would fit perfectly? My kid's room. LOL.

    Not to flame here, but I think thats the point. Nintendo games are no longer fun for some people because they are intentionally simple. I want a challenge. I beat Zelda without dying even once. WTF? Thoughout the game I kept thinking that I was over it, but I paid for it so I felt obligated to beat it. My GC has since be relegated to GBA player duty.

    I know reading is hard, but in the first paragraph I define a casual gamer, and in the second I list the limited exposure to video game advertising a casual gamer has. Try to keep deliberately separated concepts separate.

    Ah, but I do agree with the original poster in some of his notes, but not what he concludes from them.

    MS does what is does and SCEA does what it does in terms of image building and hype. They do NOT affect the GC's. They are not running "...what NintenDON'T" style commercials (thought it would be both funny and true). Nothing is accountable for the substance of the console but Nintendo.

    It is NOT an image and its NOT based on hype. It IS what Nintendo IS. Not image or hype, just substance. Kiddie substance.

    You say I say Nintendo is hurting itself by this? Care to point that out? I just list what they do. Nothing wrong with it, they just can't say they aren't doing it.

    I don't think they "deloped" ED, RE, or any of those games. They published ED, but thats the only one. The others they merely allowed them to be released. Thank you for bringing up MK though, go back and check it against the arcade and Genesis versions. Come back, then remember that was your arguement, not mine. LOL

    There is nothing wrong with being the console for kids. The Gamecube is, but its not image, its the substance of the thing. Try to comprehend. Unless its'a you, Mario. Not for kids,lol.

    Lets see scanning post for the word video...nope, I didn't use it. Its good you concede the overall point though, however subtly you do it. There is more to hardware limitations than texture quality and anti-aliasing, as we all know.

    And you only mentioned the RAM aspect. I was looking at the overall. You lose ROM with the Gamecube disc. Good-bye assets. And how is the backup data storage doing?

    Its a fact, some third parties are dropping support for the Gamecube (see Sega Sports as one example) because it is harder to work with and returns less in $. They couldn't ship any of the 2k3 series without crashes due mostly to hardware limitations, then announced its not worth it. No 2k4 for you.

    If it was the most powerful you wouldn't hear these complaints.

    A simple test for your hypothesis. If Russians who coded for me have arbitrary claim to my code that say, Indians (or even Americans, imagine that) would not have, why would I risk doing the work in Russia? There are plenty of places to get cheap labor.

    Result: No, they have no claim or noone would be doing business with them in the first place. Too risky.

    #1 It doesn't matter if you rang from a pay phone. MS is omnipresent and would be at your location before you hung up.

    #2 You didn't actually have a right to pick up the briefcase in the first place. Since your hypothetical mentions removal of identification, you knew the briefcase wasn't yours. This act was theft and yes you have committed a crime, to answer your rhetorical. Though unlikely, you cannot assume the briefcase was not left there on purpose. You stole the briefcase and its contents regardless of what those contents are, where or when you found or lost them, or if you ever turned it in.

    #3 You should always be careful crossing train tracks when drunk. You could lose an eye.

    #4 MS could actually record your conversation since most US states only require one party to actually give consent. The party doing the recording counts as one party. How do you think all those prank calls get made and aired legally? And lets not forget, you probably left prints on the case since you were pissed when you picked it up. Now all they have to do is call every police station in your area, find the briefcase, prove ownership, play the call back for the cops, take prints from the case, compare to known prints (yours are certainly on file as a known drunkard), knock on your door, and arrest your silly arse.     I WAS speaking of the casual gamer. Here is the definitions since you don't seem to grasp it AC. There is casual gamer, gamer, and hardcore gamer. If you are reading games.slashdot.com, go to E3, import games, etc. you = hardcore gamers. If you subscribe to EGM, have more than one platform (include PC as a gaming platform here if it is used for games), but don't know the online handle of any game developers, etc. you = gamer. If you don't do any of that, have only a PS2, can't think of the name of a game developer, but have Madden and Vice City, you = casual gamer.

    Do you get it yet AC? If you respond again I will be happy to list some more specific examples of what kind of person is each if you can't figure it out yet.
