The company I work for has recently started a program of donating old PCs to schools in various parts of our country. Of course the schools (Who can't afford to buy hardware) can't afford the licensing fees on commercial software, so Linux (And many other open source products) is filling the gap and providing working systems for teaching and learning.
It would be good if the Linux community, as a whole, saw these criticisms in a positive light rather than getting our collective backs up and getting on the defensive. If Linux is ever going to replace Windows, we all have to be prepared to listen to criticism and then do something to correct the weaknesses, even if the weaknesses are only perceived, because to the perceiver, perception is reality.

Just think about what they are doing now. Do you really think that they had no idea what their legal costs were going to be? They must have known right from the start that they'd recover the cost from their customers. So hire the most expensive guy in town then when they lose the case, they blame it on him? Yeah! No wonder we hate 'em!
I've worked as an IT contractor for over 10 years now and IMHO it works really well. Many companies, specifically for their IT needs (Well that's the area I know best and that I'm most familiar with), choose to outsource rather than employing full time staff. In the IT industry, with things changing so rapidly, it makes sense to outsource your needs and when a "need" has been fulfilled, the outsourced staff move on to a different client.
I live in South Africa where, not to many years ago, sentiments such as yours were considered to be official government policy. Thus I'm pretty sure that investing money in education, rather that in weapons technology, is a much better investment.
... if the time and money spent of developing new weapons could be spent on education rather. But then again, a better educated future generation would probably be able to think up even more devastating weapons.
