Technically, they haven't read or agreed to the the agreement and the can't read it because it's gone.

Did anyone not see this coming? Really, this is not a surprise. It still falls under they same anti-competitive tactics they have been using for a while. I hope this hurts the movement into the Colleges with their shared source attempts. Maybe the will shoot their own foot. Either way, this is more cannon fodder for the plethera of lawsuits out their! Mailling lists are the equivalent of talking in a group of your peers. You have to sign up to be on most of these mailing lists. There won't be much difference in saying these things in person, and saying them on a mailing list. The word would still travel. Do be suprised if you see someone getting sued for casual conversation amoungs your friends and peers because you had a bad experience with some company. This is stupid!

The store owner should have handled this better. Sueing everybody in sight is not good PR. At this point, he should go out of business because who will want to buy anything form him now? Sueing a defense fund? Is this person insane?!?!

I am tired of all these stupid lawsuits being allow to go foreward, or at the bare minimum allowed to reach a settlement! Somebody make sure Microsoft doesn't hear about this because they may find that this will fund the new revenue stream they've been looking.

You are forgetting something. A program can be modular, but that doesn't mean that parts can be easily interchanged. A couple of things are being confused here. As a programmer, I tend to break down problems, ideas, etc. into groupings that make sense. I think what you are thinking of are the modules, or broken down parts, but don't forget that even though a system is modular (or broken down into parts) it does not mean the modules are interchangeable with other modules. That must be designed into the project for it work smoothly.

Using problems solved per day wouldn't be good. For one, some problems and projects can be spread over days, weeks, and months. This means that the number of problems solved will be less for someone working on a harder project than someone who works on simpler projects (and problems).

Also, I would also have to disagree with the article. The following comment really isn't true: "[h]is code is shorter and simpler, and simplicity is almost always better in engineering". The larger code code be contained in well thought out objects, or functions, that make the reading of the main Objects, or functions, simpler to read, and the main bulk of the code if well engineered could also be reused easily.
In his above example, Danny's code may not be anymore reusuable than Fred's. Danny's smaller number of lines per code could be result of not taking into account all necessary possibilities, or not thinking about possible future problems.
The size of the code just doesn't matter. What does matter is how well the code is thought out and commented (both insertions and deletions of code). Well thought out code usually can produce some reusuable code and/or design patterns. Personally, as a rule of thumb, I don't like to write code more than three times for a given task or problem--unless I absolutely have to write it more times.
