It's not like the trailer maker has to go out and do a new shoot, edit for lighting and audio, add CGI effects etc. He LITERALLY has to watch the movie and at a few points go "Ooh, that looks awesome, that goes in the trailer!"

Remember Spore, with multiple different game modes depending on your evolutionary stage? It could EASILY take 30-50 hours to get to the space stage and zoom around there a bit if you were an explorer, only to realize the endgame was... quite lackluster.
Since Sony is completely free to sell his digital copy of the game again, and can even do so without having to label it as used, he is not a thief as he has not deprived them of anything.
No one said the company isn't allowed to turn a profit - but as a patient, do you want the sole supplier of medication that keeps you alive to suddenly realize they are the ONLY REASON YOU ARE ALIVE and bumping your daily expense up to a million dollars?
Unless he claims to have some kind of psychic ability there is ALWAYS the possibility of misidentification. If those were his words, the case should be thrown out for lying to the judge.
