His point was that the only factor we changed is that the interaction is now noticed by humans. The claim here does sound a lot like someone thought "observer" means a sentient being. If you don't put a detector in the photon's path and the photon hits the wall instead the photon's wave still collapses (or a universe is selected, depending on how you see it). The story makes it sound like there's a difference between the photon's impact being "observed" by the wall and by some scientists reading the detector's output. If that was not the claim then our measurement of the dark matter wouldn't have an effect because the planet would still be hit by that radiation and still cause it to be "observed", just by an inanimate surface instead of the self-proclaimed king of creation.

They had a contract. The supplier failed to follow it. Breach of contract is handled like this, I doubt the contract had anything about "just return it and go elsewhere" in it (also I'm not sure govt spending can be redirected as easily as that, remember that there's the whole lowest bidder thing to go through). Even if, that would cause additional costs for the govt because of the additional work to get another machine made. If a store sells you a product that's not what you told them you want that's fraud, if a supplier sells you something that's not what the contract specified that's breach of contract.

Perjury is lying under oath or under penalty of perjury. While you cannot put others under penalty without their consent you declared yourself that you do this under penalty of perjury which is pretty much the same as giving an oath. I'm not sure there's any law preventing you from putting yourself under an oath when you choose to do so.

Nintendo may not have the respect of the hard core gamer, and doesn't deserve it, IMHO, after rehashing the same IP over and over again and focusing on children

That must be a very soft hardcore gamer you're thinking of, my definition of hardcore includes the ability to overlook superficialities if the game is good, someone who plays the games to look cool instead of the gameplay is not part of the hard core of gaming. Reviews rank Super Mario Galaxy as the second best game of all time (currently, of course that'll change as more reviews get added but it's a really strong start) so that'd have to be a strong aversion against sequels (which apparently isn't an issue when the IP that gets sequelled involves blood and gore, eh?) and colorful games.

FFCC wasn't much fun in singleplayer because of the repetition (not just the levels, many enemies require fighting in patterns and those patterns get repetitive) and because it had its complexity in the wrong spots (crafting, anyone?). I expect they have learned from this though and the next bunch of games won't have these issues.
