  3. There will always be an overlap of people willing to work and job offers. Can't find the source of the info, but it is basically that there will be a period where people will look for a job. It will be jobs that can't find qualified people. (e.g. nurses) or the people are not in the right location. e.g. jobs in London and people in Northern-Ireland (Or continental Europe)

This will be the case no matter what. So a 0% unemployment would never be possible in a real life situation, even if 100% of the people is willing to work and is actively looking for a job.

"Just take a job at a lower pay" is not an option as many will be overqualified and be a risk for the employer as leaving before they start making a profit for the company. Why would you put 6 months into a person if he leaves after 7?

  9. The thing is that many companies (e.g. banks and government sites) have been saying that you should look to see if you see a lock, as if that would mean that the connection is safe.

The thing is that that is NOT the case. Secure and safe are not interchangeable.

  10. These things happen. We had an item for sale where you would get another item for free. You would then have 2 items in your basked. You could delete the one item you had to pay for and thus receive the other item for free (+ shipping). So we cursed a bit, honored the orders and put it in as cost of doing business.

Notb that much different as having the wrong price in the store. Things happen. Does not mean they will have to honor it if the standard price is 10.000 and they put it up by accident as 10, because that should be obvious as being an error.

  11. Several years ago I found childporn and reported it to both police and the ISP.
ISP was not allowed to do anything by order of the police, even if they already know who placed it there. The police called my company (from where I had done the report) to ask for my data and told them it was concerning an investigation about childporn.
When I was helpful and went to them they tried to get me for:
    1) Obstruction of the law, because I informed the press after a week, because the site was still up and they where working on it.
    2) Fraude, because I had given a fake address at the free email company
    3) Spreading of childporn, because I had done a reply on Usenet and had forgotten to remove the URL

I am happy that my company was understanding and I did not lose my job.

Since then I have NEVER seen anything remotely illegal on the Interwebs, ever. If I would I would obviously report it, but somehow since that 15 years ago, it seems as if there is nothing illegal going on online. Really absolutely nothing. Weird.

And that is why in Belgium the law almost always sides with the employee. An example:
As a manager you will perhaps sign that you will not get any payment for overtime as you already get a premium payment that includes this.
This is not legal and if you get enough proof that you did overtime, when you leave the company, you will most likely be able to force them to pay you these hours. (Ask a specialized lawyer, not the one that did your divorce)
The only thing you need to say most of the time is "I was afraid they would not give me the job if I pointed it out". Case closed, please pay.

Obviously it would not be very wise to do if you are interested in working anywhere else and it might even be immoral to do so, as it was clear that this was the case. Yes, there have been managers/directors that received extra payment.

To me it seems as if California sticks closest to the "For the people by the people" communist/Christian principle.

  21. Re:Voluntary Contract on California Lawsuit Wants To Weaken Noncompetes (axios.com) · · Score: 1

In Europe it can mean that either the complete contract is void, or parts of the contracts are void. This will depend from case to case. Basically any contract for work will be an extension of the law and can not be negative for the employee. The decision of the court will always rule in favor of the employee if there is any doubt.

  22. Re:one solution on California Lawsuit Wants To Weaken Noncompetes (axios.com) · · Score: 1

    Works like that in Belgium.
As I learned from a HR- course about working laws in Belgium a non-compete in Belgium (and most likely the rest of Europe) means the following:
First there has to be a period. e.g. 1 year, next there needs to be a price linked to it e.g. 3 times your salary, and lastly it should be for a higher function, so not a store clerk. So we are talking about higher management in reality.

So what happens when a person leaves (willingly or unwillingly) and there is a non-compete contract? The person that leaves gets the monies. (Don't forget to ask for it) as he is not able to work at certain companies. The fact that he retires or starts a bakery does not matter.

I had one and the moment they fired me, they canceled the non-compete. Not sure if they did the same to the CEO and CFO that where fired at the same moment.

Not many people in Belgium know this. If you are in a similar situation talk to a lawyer that is specialized in these things as it is a very specific subject in the law. It could be that the company owes you money. It could even mean that your are not even obliged to follow the non-compete because you did not earn too much and then you can work anywhere AND get the monies.
Again: talk to a specialized shark.
