You can't seriously be suggesting that organized religion and political government should work the same way. The two ought to work differently. The former is based on dogma; the latter, ideally, on reasoned dissent. And I would think this would apply at all levels.
Great! Glad to know that you understand the power of the market to shape things. Say, um, why wouldn't you think that Windows, which is produced by a completely market-oriented company, would be shaped by the same influences?
In case you didn't realize, Microsoft is a convicted monopoly. This basically means they violated certain principles of the free market and were "therefore insulated from competitive forces". Apple, with its constantly improving 10.x series compared to Windows and its stagnating OS and browser, is a good example of how a non-monopolistic company responds to market forces. But they're only shielded from Microsoft's monopoly because, yes, they serve a slightly different market.
I think Audioscrobbler works pretty well for this kind of thing. No intrusive 'rating system'. No isolated file downloading network (Gnomoradio, iRate) to divide the potential pool of artists. Just download a plugin and play the music you would play anyway. Go to sites like 3hive for freely available indie tracks and check your recommendations every so often. Simple.
What about the questionable status of Fiona Apple's latest album? Some say it was intentionally leaked, too. On the other hand, if it was actually 'shelved', would it technically still be prerelease? Would fans face a three year sentence for sharing something that might not have seen the light of day anyway?

Heh. Funny how the bill was originally created in reponse to the premature distribution of three of the suckiest movies of all time. I'm sure seeing those movies beforehand allowed lots of folks to avoid wasting money on a theatre ticket (or DVD rental).
Disconnections from my University network pushed me to give GNU/Linux an earnest try. People may not switch in droves, but there may be just enough resultant frustration to have a positive effect.
Have you seen Pimp My Ride? It's actually fairly entertaining television. And this is coming from someone who watches at the most 80 minutes of television a week (The Daily Show).
We live in a society of laws. Why do you think I took you to all those "Police Academy" movies? For fun? Well, I didn't hear anybody laughing! Did you?!

Does this mean sites like Archive.org's Live Music Archive and bt.etree.org have to be shut down as well? I was under the impression that if the artist permitted taping and redistribution of live shows, it was all legit. Of course, I am aware that there were some instances of trade-unfriendly tapings being distributed through easytree (e.g. Bob Dylan), but all they'd have to do is implement a stricter policy of what can and cannot be seeded.
Have you heard about The Long Tail? It's a great article on just how catering to the obscure/cult/indie/less popular tastes is not just a good idea for the improvement of our collective culture, but can also actually be profitable. Still, you won't see any of these megacorps thinking too clearly on the issue for some time yet.
