I think the fact that it's "except Bush has signed the bill now," is the most pertinent. I think that calling this a dupe is like if there was a story about the pope dying and the cardinals being convened, and then we called the article about who finally got elected a dupe.
I would have thought that it's a subject of the noun clause (whoever attempts), with the whole clause being the object of the preposition, not just the "whoever"

Won't work. At least, it would diminish the amount of valid lawsuits made by normal people against companies. What if I sue and loose on a technicality? I can't afford the chance.
