    You do not buy rights from artits or publishers or anyone you actually go to BMI and they figure out how many people listen to you and based on that you pay a fee for how many people listen. It is just like if you want to play music in your resturant or anywhere else you have to go to BMI and pay them based on how many people your resturant can hold (normally around 1k a year for a resturant).

    Oh yes that is 100% incorrect. You could just draw a line and the fact that you would get the money would show that you signed it. Also if someone witnesses you signing it then you are in even more trouble if you go into court and tell a judge you did not sign it and the witness says you did. They certainly dislike people that lie and you would be thrown out of court so fast you would get more than whiplash.

    Most places actually have employment boards that will answer questions like this for you. I had to sign a contract to work for a company once that said I could not sue them but instead we could go to mediation (which just costs a lot less). I had talked to a lawyer after that said you can always sue even if you sign something saying you would not sue... it would then be up to the judge to figure out in your case if it is legal for you to sue or not depending on what the situation is. If you are leaving and see no reason to sue them why pass up your severence package?

    Sure this might be off topic but I think they need to get real developers working on their sites before I buy a car from them.

    Serioiusly they don't want you on their site then. In all honesty you have done nothing for gamspot.com. If you are not willing to part with 24 dollars a year (actually 19 at the introductory rate) but are willing to go leach off their site because it means you never clicked on an ad on their site and never purchased something from an advertiser on their site.

    While I am not sure if you are an active reader of gamespot.com, I would be willing to say they probably wont miss you but down the road when you are looking for a new game and need a review you will miss them and you will wonder why you never clicked on an ad before which probably would have made it so they would not have needed to charge money right now!

    I do not use music swaping software much but when I do use it it is usually a time consuming task to find the songs I actually want. I know I would be personally happy to go to a site like cdnow.com where I could preview each song (30 seconds) and then download the song for anywhere between 50 cents to 1 dollar.

    I cannot see how anyone else out there would not be willing to do this as you would get exactly the songs you want and you would download them at a fast rate. Downloading over a DSL line with at a max rate instead of at 5-20k a second would be well worth the 50 cents to a dollar.

    I know I would still go out and buy the cd's because there are some kewl things that come with cd's like memberships to sites to download other hidden tracks and lyrics or what not but I can promise, like most people, that I would go to a site and pay 50 cents to a dollar before I go to limewire because I know it would take a lot less time.

    If I were to go hand written I would make a comment that says this is hand written to show you what the future holds. If this law is passed I will have no choice but to stop using electronic devices for many reasons including my own morals. The recording industry is pushing for more protection than the Copy Right law allows and in their case against Napster they showed, by not giving the artists any money, that they are in this to make money for only themselves.

    To help such an organization while hurting the law abiding consumer is just not right. I would also like to inform you that I have spent 10's of thousands of dollars on cassetts and cds in the past but ever since the Napster trail I have not spent a penny and will not spend a penny until things like this are fixed. So if they want to complain about hurting the economy because of no copy right protections maybe you should send them a message to look in the mirror and see what they are doing. Maybe a reference to what they tried to do with VHS back in the day would help.

    An e-mail contract is a written contract so it would only make sense that it is legally binding as long as someone is not saying it is forged.

    Forgery has nothing to do with this case though. He is not saying he did not send the e-mails what the guy is saying is that it is not a contract... which is incorrect. If I called him up and said "Hey I will buy your house for 1.895 million." and he said okay... then we have a verbal contract so why would it be any different if it is in an e-mail or a hand delivered letter or by the phone. A contract is a contract.

    Now this would be a totally different case if he said he was not the one that was sending the e-mail. I think it would also be a totally different case if he said "You know what... I don't want to sell it anymore". But the simple facts are he wants to sell it, he did send these e-mails, and someone came and offered him more money and now he wants the extra money.

    I know when I e-mail my lawyer they charge me for about 15 minutes in most cases at an hourly rate of 250 an hour so it makes sense that if this spammer is mailing them all day long they should get charged as well.

    I am not an aol user but I am a SprintPCS customer and I ran into something much the same when I signed up a year and a half ago (omg has it really been that long) for their service. I selected the wireless web over the free night and weekend minutes on the web site.

    My order was processed and when I got the confirmation e-mail it even said that I had selected the wireless web. I then get my phone and everything and it says that I had selected the night and weekend minutes. I call them up and I am like I selected the wireless web not the night and weekend minutes and he was like it says you selected the night and weekend minutes and he obviously thought I was retarded.

    I am like dood... I have the e-mail right here saying I selected it the wireless web and not the night and weekend minutes do you want me to send it to you. He was like no but you still selected the night and weekend minutes. Then finally he asks well what do you want to do... I go I want the web not the free minutes and he ended up giving me 6 months free of the web. I was like well can you get me in touch with the web department so they know there is an issue and he was like we are the web department. I was like oh god... and he did not even care that the stuff was not working right.

    I would not doubt that some of these people actually selected no thanks but still got the stuf anyway after that experience.

    Someone needs to read but it seems as though it is you. "The large ads that you see on many other sites are coming here." they say nothing about pop unders or anything like that which would make no sense at all because the subscription is based on cpm and if they start making each page have 2 ads (the banner and a pop under) then that would be using 2 impressions per page which is something they are not going to do.

    That almost makes sense. You visit slashdot all the time and you see ads. You never considered leaving before but and now that they are going to allow you to subscribe so you do not have to see ads you say lets go somewhere else that forces me to see ads.

    This whole thing seems simple enough to me. AT&T had some share of @Home due to it buying a cable company so they said hey lets see if we can make this thing work because it will be less expensive for us due to the fact that we will get some money back for the other companies that use @Home as well.

    They send in their top guy and make the network go from shitty to great in a matter of months and then @Home says oh shit we are still running in the red we need more money. AT&T says hey lets buy them out this way we make money off our own subscribers and money off Cox and everyone else that uses @Home plus everything is already there cause our guy built it.

    They offer money and @Home is dumb and keeps asking for more and does some stupid stuff to drag their feet. AT&T says shit we hae 805k customers that are going to get pissed if this network goes down so we should make our own network (not like they have not been making networks before they were even called networks).

    Now @Home share holders are feeling retarded because they wanted more money and now they are going to end up with nothing at all so they complain that AT&T did something , when in reality AT&T prolonged them going under.

    When you add it up the 4 billion they spent on the system they are discussing here only a small portion... maybe 5 million or so was spent on licenses. In the grand scheme of things 5 million is not much at all to spend on licenses.

    Sure I like the idea that it could be less expensive but I think that the less expensive part comes when you are a smaller company that has a linux geek in there that can make everything work transparently for you. See you save a lot if you can use MySQL or another open database instead of psending 40k on an oracle license for a processor. Right there that almost pays the linux geeks slarary for the year.

    The difference between them and an iMac is that they are just cute where an iMac is actually cute because it is functonal. It just so happened that by putting everything in its optimum place the iMac became cute and not because they wanted it to be cute.

    I am not understanding how sending an SMS message could cost Orange any money. They have the infastructure in place already. I would think it is much like setting up a local area network and then transfering files. The system is already setup so it does not cost anything to actually transfer files.

    If I am wrong then okay but it does not seem as though I am wrong. Orange owns the stuff already and any money they get at all for SMS is just gravey. I think what happened was someone was like OMG 300k messages a day at 0.05 would give us 15,000 a month and we are only charging these guys 60 dollars a month so we need to change things because that is a lot of money.

    This is an odd question because both code red and nimda were actually viruses that took advantage of things like directory traversal and admin tools on the system. In short most admins already knew about these issues and fixed them themseleves by disabling the dir traversing and removing the template site.

    So in short to answer your question when it comes to code red or nimda you really should not have a problem if you are a good admin. The same is true in the linux world and newbie web programmers that do things like system calls without checking out what is going to be called. If you call something that the users passes to you then obviously they can do things like tracrt ip; rm -rf / and your code would let it. This is not perls fault or php's fault or any other languages fault it is the programmers fault.

    As much as I dislike windows, mainly because I have been an asp programmer for a long time and I would rather use linux and do perl programming (which I do now), Microsoft is somewhat right in that a knowledgable sysadmin already had the holes fixed. At the same time they should not send out software with issues like that.

    Integrading other things is different than adding more crap. Example with apache, mysql, and everything else running my system uses about 60 megs of ram. I start up KDE and bam 150megs are getitng used. If they ad more crap (things that are not needed and should be placed as options when installing) then the memory use only gets more and more.

    The average windows user does not even know what AIM is never mind would they want it incorperated into a browser. Second IE does not have a media player built into it, it is a simple addon and you can do it with mozilla just set mozilla up to open all mp3 files with an mp3 player and you have the exact same thing you have with IE.

    On a side note this is the wrong place to tell the mozilla developers what you want added in. Bugzilla was created for a reason.

    The statement about having to change regions is incorrect. I live in Miami and we have a choice of either Adelphia (which is the biggest one around here) or AT&T. I believe there actually is a third but I forget who they are. However most people do not realize they have a choice because Adelphia is so large around here but they actually do have a choice.

    I am not sure where I read this; but I remember 4 years ago reading an article about how phone companies were taking pay phones out of a lot of areas and not putting pay phones in where people were requesting. The writer, if he did research or not I will never know, wrote that they were removing the phones and not putting new ones to force people to buy cell phones--which they obviously make more money off of due to the money fee.

    My philosophy was always; why get a cell phone when a pay phone is always a few feet away, but it seems like lately when I look for a pay phone they are never around when I need one so I had to break down and get a cell phone. I pay some 40 dollars a month with about 8 of that going to some kind of taxes or another and I use maybe 100 minutes of my 500 minutes. It seems like if their plan was to get more people to buy cell phones by taking out the pay phones it worked here.
