I want to sue Apple too! I've bought FOUR of them so far, and my hearing has gone to shit.

But, I also want to sue Creative, iRiver, Sony, and Sandisk. They all create potentially hazardous devices which should NOT be sold.

Although I haven't bought one yet (and it hasn't resulted in my hearing loss), I think the fact that they're even producing such devices SHOULD not be allowed.

While we're at it, can I also sue Nakamichi and Altec Lansing. I bought some of their products, and the volume is SO loud. I swear, I'm going to be deaf here soon. Oh, and Infinity as well. Can we get Mitsubishi as well? (I like to crank the volume up in my car...but it's not my fault that I'm listening to it at a loud level, right? It's the manufacturer cause I'm a fucking moron, right?? Fuck PERSONAL RESPONSIBILITY!!!! Let's milk those fuckers DRY!)

OH, one more, let's also sue the State for all the construction they do around me, as well as the city. I'm sick and tired of all the loud noise. My POOR ears...

After this, can we tackle Logitech and Microsoft? They keyboards are causing me carpal tunnel syndrome - I don't actually have CTS, but that's not the point. It's a dangerous product.

Don't quote me on this, since I just woke up, but I remember reading an article a few months ago, saying other people were considering suing Apple for hearing loss. At least with that case, IIRC, they were claiming that the earbuds AS WELL as the idea that playing 14 hours of non-stop music may cause hearing issues. Or, maybe that was the counterclaim against all the "BUT SONY WALKMANS HAVE BEEN OUT SINCE 1983!!" people saying the people were idiots...

You know, had to flip a tape over, or some other jazz...so, the Walkman vs Mp3 Player issue wasn't relevant...

Anyway, imagine if this guy actually wins? What would Apple do? Prompt the user every 30 minutes that "taking a rest, while listening to the iPod is a good idea." Or, maybe every 30 seconds on really loud levels??

If this guy DOES win, I've got dibs on Creative. It would be GREAT, because their crack pot CEO would probably declare war on me or something equally insane...

Personally, I prefer a site that loads in 1 second, with pure XHTML/CSS, than having to wait 5 seconds for a Flash based website to load up, just so it can beep as I roll over a link and then wipe my ass when I click it.

Also, I've become a "tab" man. Which means, all the links I would typically just cmd+click (opening a link in a new tab) do not work.

The sad part, a lot of people associate Flash-based sites = cool. It might be cool for like a second, but when you start browsing the site, and then hit "back" only to find that you have to reload the damn flash file again. Geez!

The only way to break the vicious circle is to start producing websites that don't work in Internet Explorer. Obviously, professional websites can't afford to do this. But hobby websites like weblogs can. Just don't bother working around Internet Explorer's problems, and use Javascript to put a notice at the top of the screen explaining the problem for Internet Explorer users (e.g. "If this website looks screwed up, it's because you are using a broken web browser. _Read more_ on how to fix it.").

And that's exactly what I've done. After wrestling with xhtml/css to display properly in IE, I decided it wasn't worth it. I slapped a "Get FireFox" button on the right hand side, and warn users that my site doesn't display properly in IE because of Microsofts failure at supporting standards.

What's the point of "hacking" a site to make it look good in IE? All that leads to is some MS exec wondering, "Why should we include CSS support or follow standards, when we know web developers will bend over backwards so a div displays borders properly..."

I would LOVE If tomorrow all the major websites said, "Notice - We are now supporting web browsers which support web standards", I'm sure a rush of new FireFox users would appear. And then, and only then, when Microsoft realizes their markets share is dropping, or the complaints about incompatibility start flowing in, that they would take standards sersiously.

Can we start a new movement here on slashdot? Make it "cool" to leave out "hacks" and what not, only supporting W3C standards??

This definition of Monopoly is better:

In economics, a monopoly (from the Greek monos, one + polein, to sell) is defined as a persistent market situation where there is only one provider of a kind of product or service. Monopolies are characterized by a lack of economic competition for the good or service that they provide, a lack of viable substitute goods, as well as high barriers to entry for potential competitors on the market.

Your statement, "Just because everyoen prefers Windows doesn't make it a monopoly", should say:
"Just because Microsoft has made it nearly impossible for anyone to choose an alternative to Windows, doesn't mean there aren't alternatives."
We know there are alternatives. How many consumers do you think nows anything besides Windows?
Hell, people won't buy anything besides Intel for the same reason they won't buy anything other than Windows. It's all they know - mainly because of Intel/Microsofts control. While not true for Intel, in the past, the combination of Microsoft/Intel made int nearly impossible for anyone to actually enter the field.

And I'm willing to bet that many people do not PREFER windows. They use Windows, because they HAVE to.

Remember, Microsoft was convicted of using their monopoly in a criminal way. Regardless of how you want to spin it (by listing various OSes), it is known that of the consumer desktop, 95% are running some form of Microsoft software. From Windows 3.1 to Windows XP, Microsoft has control.

So when a company like Microsoft decides that manufacturers like HP carry only Windows (or lose their right to license their OS), what do you think HP will do?

Or, what happens when 95% of the desktop users suddenly have a free browser bundled, right into the OS? Why, consumers use it, instead of going with the alternative (which, at one time, was Netscape) - hell, why download and pay for something, when you have a free version right there.

So you can see how suddenly, when a search engine by Microsoft is included into a browser which is built into the OS, some of us will look twice. /Sorry for grammar, spelling, rambling - too tired to think clearly.
