    collusion takes place within an industry when rival companies cooperate for their mutual benefit. Collusion most often takes place within the market form of oligopoly, where the decision of a few firms to collude can significantly impact the market as a whole. Cartels are a special case of explicit collusion. Overt collusion, on the other hand, also known as tacit collusion.

    According to game theory, the independence of suppliers forces prices to their minimum, increasing efficiency and decreasing the price determining ability of each individual firm. If one firm decreases its price, other firms will follow suit in order to maintain sales, and if one firm increases its price, its rivals are unlikely to follow, as their sales would only decrease. These rules are used as the basis of kinked-demand theory. If firms collude to increase prices as a cooperative, however, loss of sales is minimized as consumers lack alternative choices at lower prices. This benefits the colluding firms at the cost of efficiency to society.

    Practices that facilitate tacit collusion include:

    Uniform prices
    A penalty for price discounts
    Advance notice of price changes
    Information exchanges
    Swaps and exchanges

    Why does it matter what IT geeks wear? If they are not interacting with customers who cares? I consider the ability to come in, in shorts, t-shirt and a hat part of my compensation. Take that away and I want a raise and will probably be less productive since i'll have to take time in the morning to think about what fashion statement I want to make today.

    Cellular carries get away with this practice because that free phone you got really cost $300. It's nothing more then a guarnatee to get a return on their subsidie. AFAIK, you don't get a discount for activating your Tivo vs. not activating it.

    Seems like the only loser here is the consumer.

    But section 107 only says that "the fair use of a copyrighted work ... for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright".

    So if I'm teaching myself to get Windows XP Pro for the price of Windows XP Home it looks like I'm well within my rights.

    Don't know how prevelent wireless is there, but if I was to do something like that here, i'd just log onto one of my neighbors open wireless AP's and go to town.

    I'd hope I got the AP of the noisy pricks upstairs so when the secret police come and round them up for reeducation I could get some peace and quiet. Two birds with one stone and all that crap.

    I don't know whether that will be a whole lot of help, as service and trade marks are limited to being in respect of some specific area of trade/ practice, and I don't see a whole lot of overlap between sports teams and computer software.
