In my experience when I messed up and went over 5 GB, I was still connected via LTE. My connection was getting like 64 kbps (or something like that, it was one month over a year ago, so I don't exactly remember the exact speed), though.
The only phones where the mic is always on are the Moto X, Droid Mini, Droid Ultra, and Droid MAXX. The Nexus 5 is the only phone with the Google Experience Launcher, which only listens when the home screen is on.

Seriously, though, the makers of the ransomware are criminals. It's not entirely unrealistic to think they're also the type who would DDoS.
And the DDoS is probably less of a crime than the ransomware.

Where I come from, the ads on the receipt are preprinted and only geographically targeted.
On the other hand, they do have a separate printer that prints out (presumably behaviorally targeted) ads.
