  2. new US laws. on RIAA Accused of Extortion & Conspiracy · · Score: 3, Insightful

I am all for seeing a criminal trial against the RIAA, but as others have stated its a bit of a "pipe dream" to actually get it.

my main concern is the RIAA/MPAA getting new laws passed that would be similar to a criminal version of the DMCA. Here in the US it seems you can buy -almost- any law you want, even if it will get overturned by a court later and tore down by organizations like the EFF. It will still be in effect long enough to do quite a bit of damage.

see: Gonzales proposes new crime: 'Attempted' copyright infringement May 15, 2007 - stuff like this, even a lot lesser version of it is what bothers me.

I would guess in 20 years this might be as far as Virtual reality has gotten in the last 20 years.... now if we could just combine the two.. throw in a feeding tube, etc etc..... We would all be stuck in the matrix.. or we would end up with "The 13th Floor" becoming a reality.. Seriously i cant want for the world to end, then i can take off my goggles and say i want my money back, the MMORPG i been playing the last 30 years sucked.

personally i am curious how her RICO Case http://yro.slashdot.org/article.pl?sid=05/10/02/16 12238 will play out. would be real nice to see it go the distance, but at this pace it wont ever finish. Filing waves of law suits against people without any evidence, or knowing who your suing, then resorting to 'extortion' seems to be close enough to the RICO law to play out, if someone cares enough to do it..

  9. Re:There is no right age on You Played Violent Games - Why Can't Your Kids? · · Score: 1

As with everything related to parenting, there are no hard and fast rules. Good parents will get a feel for how mature their kids are, and afford them the appropriate privileges. Mediocre parents will rely on the ratings on the boxes, and bad parents (or the politically-correct "distracted" parents) will let their kids play whatever.

very true. My younger sister is quite mature and gets many privileges compared to my brother 1 year younger than her... which makes him act out even more.. lol.

as far as video games my parents were obvious as many peoples were.. i had my mom paying for a xxx bbs account not knowing what it was. (god im old.. bbs?!?) parents of this generation know more about what is going on.

only time i remember being bothered about the games i played was when i put doom on the school library computer.. the first time the librarian saw the pentagram she threw a fit.. even though i had been playing Wolfenstein 3D on the same pc for weeks.

I dont see this being embraced either. From what i can tell this is simply a silly way for the makers of this program to make money. I use it on a file example.XviD.avi and they send me to amazon.com using their referral code for that movie. It does hash the file and sends that along with the file name, so over time they might be able to do a better job. I just dont see it working that well, if your using it, you probably already have a good non-drm version of it. Why buy it at that point?

In the US there is a big difference between civil and criminal cases. in a civil case they just sue.. in a criminal case they would actually need evidence, probable cause or to get a warrant to get the evidence, by the time they got done there would be a real case or they would drop the thing. you rarely see criminal cases of a technical nature charged with the lack of evidence as the riaa does.

If the majority of people could fight the suits im sure they would spend more time on evidence and building a reasonable case, until then enjoy reading about the mafiaa on slash dot.

I decided to freeze the clock a few years ago.. this MP3 revolution seems to be quite nice. at most i will give into a new format as it gets more accepted ;)

  14. Re:Prosecuting children on RIAA Going After a 10-Year-Old Girl · · Score: 0

it seems like the RIAA is trying to let it be known that they will prosecute anyone as a fear factor. im sure this might work on a certain percentage of the population but it sure gets them bad press. For some reason they remind me of the anti-drug commercials in the US that are all exaggerated, not sure why..

I'm always amazed that it's even possible to prosecute children in the USA at all. In Germany, for example, the age at which you start to have a limited legal liability for your actions is 14; if you're 13 or younger, you can't be prosecuted for anything you do, period. (Of course, your *parents* might, and you might end up in foster care or so, too, but you can't get put on trial or sent to prison or so yourself.) I'm not sure about other nations, but I imagine that it's similar elsewhere, too.
(And it makes sense, too: when someone isn't old enough to vote, drive a car, drink a beer, smoke a cigarette or have sex with their girl-/boyfriend, why should they be old enough to be put on trial?)

the phrase "No taxation without representation" comes to mind when i think of the state prosecuting minors or allowing them to be. The whole idea of making and enforcing laws against a group of people without giving them a say so. the whole argument they use to try and convict a minor as an adult seems to argue the point that they should have the right to vote, smoke, drink, etc.

  15. Re:Grokster is in favor of YouTube on A Law Professor's Opinion of Viacom vs YouTube · · Score: 0

I fully agree with this. YouTubes main operation is not pirated material and for the points you've stated its setup stops people from uploading a whole tv show, while still removing infringing content already. Grokster model was used for around 99% piracy and not doing anything about it. obviously people are posting clips of tv shows and movies on youtube, but at the same time there is much more legal content, combined with things that might be considered fair use. This reminds me more of the mp3board case, if mp3board was mainly composed of legal uploads..

There just is not enough games out for the PS3 at the moment and not as many as i would expect with a release date pending. personally i could care less what sort of second life / sims environment they add, i would use something like that on the pc before i would on the ps3 if at all. Where is my new version of Gran Turismo, where are the great RPGs, they are set to release about a year after the console... i tell my friends dont bother buying a ps3 right now until you look at the list of games out. I really do not understand why they limit other operating systems access as much as they do, especially to the graphics card in the system. I do understand they have to stop full access to prevent piracy, hacks, etc. but seems like it should be as open as they can beyond that.

  18. agreed. on The .XXX Saga Continues in Wellington · · Score: 0

this is the general idea i would suggest. if they want to accomplish anything i would go with something similar to how movies, tv shows, etc are rated and make TDLs out of those. maybe using TDLs such as .rated .safe .kids etc as the TDL and possible combinations to separate out what the 'standards' are for kids below 7, up to like 14, 17. or whatever.

    k7.safe
    t14.safe
    t17.safe

maybe more combos, but the idea is there. moving all the porn sites to a .xxx domain is absurd and infeasible. at least with some system similar to this it would more likely to be accepted and put in place and it would be voluntary. im sure there is plenty of companies and what not that would be very willing to jump in on these domains to provide 'safe' content for kids and younger teens. might even enforce some extra rating software or what not to scan the material if possible, have ways to report things out of line, etc.

.com .net .org and all the other TDLs need to be left alone, consider them rated X or whatever.
