As far as I know, the way the 3-strikes laws are supposed to work are only to disconnect your home ISP access. You're not 'banned' from the internet entirely, just from subscribing to it as a resident. I'm not so sure how this treaty works, though.

Also, this is nowhere near the first console ban Microsoft has done (they did a good job hitting the users right after the first DVD drive mods came out) and hardly any false positives if any have come up. Being a closed system (unlike PCs) they can tell when something is different about the hardware.
They can't enforce it, people tether with Verizon phones now without tethering plans, and there are already tethering apps for Android. Also, Exchange is only extra if you're a corporate customer.

I'm not trying to disprove your point, but try backing up your iTunes Library files next time and you shouldn't have that problem. Just last night I deactivated my computer from iTunes, backed up my iTunes library, formatted the computer, restored my library, reinstalled and reactivated iTunes, and synced my iPod Touch like nothing had changed.
